NASD Hearing Panel Sanctions Former Knight Securities Executives for Supervisory Failures
An NASD Hearing Panel issued $100,000 in fines against Kenneth Pasternak, former CEO of Knight Securities, L.P. (now known as Knight Equity Markets, L.P.), and John Leighton, former head of the firm's Institutional Sales Desk, for supervisory violations in connection with fraudulent sales to institutional customers in 1999 and 2000.
In addition, Pasternak was suspended in all supervisory capacities for two years, while Leighton was barred in all supervisory capacities.
In March 2005, NASD's Department of Market Regulation charged Pasternak and Leighton with failure to supervise the firm's leading institutional sales trader, Joseph Leighton, who is John Leighton's brother. The NASD complaint also charged Pasternak with failing to establish and enforce a supervisory system designed to ensure compliance with federal securities laws and NASD rules.
In a 2-1 ruling, the panel found that Pasternak and John Leighton failed to supervise Joseph Leighton's trading activities. "For all intents and purposes, Joseph Leighton ran the Institutional Sales Department as he saw fit," the majority ruling says. "Pasternak, John Leighton, and Joseph Leighton each concluded that as long as the customers did not learn of the extraordinary profits Knight earned on their orders, there was no limit to the amount the firm could make on an institutional order."
The majority also found that Pasternak's response to numerous red flags was "woefully inadequate," that Pasternak and John Leighton "never questioned Joseph Leighton's activities or confirmed he was providing his customers with best execution and a fair price," and that the overall supervisory void "allowed Joseph Leighton to take advantage of his customers over a 21- month period by filling orders at prices that netted Knight unreasonably high profits."
In April 2005, Joseph Leighton agreed to a bar from the securities industry and a payment of more than $4 million to settle charges by the Securities and Exchange Commission (SEC) and NASD that he made millions of dollars in fraudulent trades with Knight's institutional customers. The SEC and NASD found that Joseph Leighton generated excessive profits by pricing trades with institutional customers in a manner contrary to customers' expectations and industry custom, and using deceptive trading practices to disguise both his pricing and the amount of Knight's profits.
In December 2004, Knight paid more than $79 million to settle SEC and NASD charges against the firm arising from Joseph Leighton's fraudulent and deceptive conduct. More than $3.3 million of Joseph Leighton's monetary sanction and more than $66 million of the firm's monetary sanction was paid into a Fair Fund established by the SEC to compensate investors harmed by Joseph Leighton's fraud.
Unless the matter is appealed to NASD's National Adjudicatory Council (NAC), or is called for review by the NAC, the hearing panel's decision becomes final after 45 days.

I said that because Portman was one of Rufus's merry men back when all this crap hit the fan .
The only chance this company has to get back on track is to :
Hire an attorney to deal with the SEC in Federal court
and
Hire a person to come in and get the filings straightend out with some real audited financials .
If you guys think this was shorted before , just let this POS open back up on a regular market with nothing but Rufus to back it up . Hell I might even have to get me an over seas account to short it into the ground . Its a guaranteed win for sure .
If CSHD has billions or even millions for that fact , hire an attorney and get the ball moving foward .
I will make this prediction today and mark this post . Within (2)years from now CSHD will be a non trading or super light trading shell and Rufus will be in jail . If he's on probation already for DUI and has been to jail twice now since the beginning of the year , he'll screw up enough that they will revoke his probation and throw his stupid azz in jail to serve out his sentence .

The "anchor around the neck" is the default judgment...Had the complaint been answered in a timely fashion, with some sort of competent response, the default could've been avoided.
From there, line up an MM via 15c2-11 and "pow" ... back in action.

I agree with you Tex and have stated many times that the default was the only thing that matter. Unless/until that is resolved nothing will go forward. It's all hot air until then.
The 2 items posted today one by me and the other by 10 of worthiness, IMO, illustrated that shennigans to happen in the market especially in the penny market. There are many who stick their head in the sand and claim that NSS is a fantasy and doesn't happen.
I believe that myself and others who post on this forum have also used this play as a tool to learn from. I can say that I have gained a lot of valuable insight from following CSHD and other stocks in similar situations. As you pointed out the big difference here is that no one from the company bothered to take care of business when it should have. They should have paid more attention to the CEO of Overstock who continues to run his business while carrying on the fight.
Anyhow, point well taken.

I think laws need to be changed...illegal shorters need to be punished, & an agreement needs to be made where counterfeit shares should have to be bought back than crumpled up & thrown out the window...

It lists off the shares outstanding on 9/5 as about normal and by 9/29 the shares "held" in those brokers exceeds the outstanding.
The day after he posted that he had a heap of trouble come his way....
Rufus had a "meeting" Friday morning...won't say with who....
He did say that he already turned down an offer...people are speculating that he was getting presented with a new offer....
Later in the day he came back to post dollar signs & smiley faces & told people who were asking a lot of questions that he could not answer because it would jeopardize the case....He also said that things are moving so fast now 'cause we are so close to the end...
If I get time later I will post them over here...but PLEASE do not kill the messanger, if you have questions, discuss it amongst yourselves or like Wally said go ask the person who posted it...Thanks everybody...
