This is from milliam's post earlier today. It was a summery of what the SEC attorneys were saying at court on Tue. --------------------------------- Bill then went on to say “we’re going to find something”. I heard that one quite clear. So, they have nothing at this point? They won’t stop until they find something? ----------------------------------
IMO they don't have chit, they're chassing ghosts because they don't even know where to start. These are the people who stopped our party. I say that Ms Blacks email should find its way to Judge Cooper, that is the least that should happen to these clowns who halted a stock after taking advise from a criminal and illegal shorter...JMO

She certainly has gained my attention! Let me see, i suppose an attorney could release stuff like that into a shareholder community that she knows is "close" so it travels all over the place very quickly. I also suppose that attorney would need to be careful if she was only sending SOME of the documents. Im not a lawyer but id love to hear what one has to say on this matter.

Good lord, my dd is finished. Anyone from this board can talk with the SEC and they will tell you anything within the letter of the law -- nothing more. Just pick up the phone. The judge isn't going to look at anything that is not presented by either side as evidence, so I am sure the company has all those defense points. You all know that. If you want further dd, then finish it yourself. I'll let others continue this discussion if they wish.
It may be weak evidence but the following is case law and we have to deal with it. The SEC has a lower burden of proof than the litigant -- page 14 of the memo to support the tro -- but you would know that since you read it. I'm going home now. 45 minute commute.

Why would a SEC attorney email documents to a shareholder that he himself could get on Pacer? Am I missing something here? They were the same documents, right? What exactly is the "dd" that wv did?

I agree. These documents are in PACER for public viewing. The DD that vw did was to call the SEC directly. It sounds like these lawyers are on a fishing trip, sending out these documents and looking for someone...anyone...to refute them.

OK, if they are my bad for trying to produce something good. But, for goodness sake, no one should throw out the baby with the bath water or throw out such outlandish and insulting accusations. Ask me questions and I will gladly answer all of them.

I'll refute them... the bonds are real. the company has 7.2 Billion in assets, and because of his ability to back up his word with existing funds the CEO at the time was not acting recklessly in annoucing the existence of those bonds. Case closed.
Wow... and to think if I would have taken the Pre Law route in college, I could have charged a $1000.00 for that statement.

I guess my point is is that those documents are not new, they have been on Pacer since the end of October....you made it sound like these were new documents that the SEC emailed to you....at least that is how it sounded to me. IMO

The SEC during any investigation should NOT be communicating or commenting on anything during the open investigation...especially on a current trading company.
Since some of these declarations are new to me (I hadn't seen a couple of them- they weren't on http://www.digitalislandsinc.com/misc/index.html and yes I am sure they may be on pacer but the point is its **some of the declarations not all) It could persuade me to dump all of my shares tomorrow (fat chance of that happening).
So in essence the point of the SEC silence is to not effect the PPS during the investigation correct?
If the ATTY only sent you some of the early on depositions which led them to believe in fraud that seems rather one sided to me.
IF the SEC is making contact with the shareholder community they have to show the entire hand- not the few cards in the SEC favor.
The whole thing seems odd and not sure why they would communicate during an open investigation!

Public documents. Public documents. Public documents. A government entity, for the most part, must give you those documents when asked -- and I asked. Now you can see all of the SEC's filed evidence. Why would you not want to prepare your defense without all of it. It's called discovery. The SEC has to release it.
