Yes, the first subpoena was supposedly from the FBI for a grand Jury that took place on the 9th of Jan but he recieved the subpoena on the 17th.

IMO, people are really trying to cover their A$$. Who needs to and who doesn't is yet to be determined but the Chit is about to hit the fan.
From having read everything out there on the other boards, I tend to believe and this is just my personal opinion, that RPH was successful in getting the default set aside and the case will now move forward.
Why do I believe this? Well, Rufus is saying case dismissed but when reading what Rufus says it seems necessary to read between the lines, therefore when I combine this with what James Gee(Dogmondo) posted, I think the SEC is now going forward with collecting evidence.

What you say maybe true but it is completely up to the Judge to decide whether to set aside a default or not and it is set aside more often than not becauses Judges want cases determined on the merits of the case and not technicalities.
Rufus has every right to defend himself, remember that the SEC is the one who filed the action against CSHD AND Rufus.
I am not saying that he won the case or will win the case. Just saying that it would not surprise me if the Judge decided to set aside the default and allow Rufus to answer the SEC allegations.
Keep in mind that these are still allegations and nothing more until a court/Jury finds different.
I'm just hopeful that the court case will go forward and that we will be given more information because of that. Let the chips fall where they may.

No Bucky. Like I said in my postings, nothing on PACER yet. Actions usually take a few days to appear on PACER. I have seen the digital copy of the subpoena for the records tht James Gee has but it also is only a digital copy of a digital copy so I would not call it evidence.
Seems that many people around this play think it's funny to put false information out there or should I say misinformation.
I can handle it but I find it cruel because there are many people who invested a big sum of money and the BS affects them. All the Ups and Downs.
I hope that the activity taking place does mean that the case is going forward so that there is closure one way or another.
I watch because I've learned a lot here. It's been very educational not just in the legal and stock investing world but also in the field of human behavior.
It's been worth the price of admisson for me and I will see the end of the show.

No one is stating that the case was dropped. Rufus said a case was dropped but never stated which one. If you read the postings you will see that we are only attempting to read between the lines as to what was dropped. The Animal Cruelty? THe default? or anything else.
PACER will tell us.
I'm actually surprised at what Alana has said about the case since it is the SEC's norm to NOT comment on cases that are pending.

She only commented on the information that was public knowledge to me . When I pushed the other questions , she started to comment but quickly stated that she could not comment on the question . She did make it perfectly clear that CSHD had not responded to the case properly and to the best of her knowledge still did not have legal counsel .
This conversation was several weeks ago and I do not believe anything has changed reguarding the case with the SEC . As far as the case on his animal abuse charges , I don't know and don't care .

What "source" posted seems much more in keeping with the responses I've ever gotten re an ongoing investigation. I called her but it seemed to me I was getting into "phone tag"...never did follow up. Others at SEC seem to have no problem returning calls...or NASD, for that matter. May not be as quickly as we'd like, lol...
But I hear you: by what they post, should be no comment. I understand that, too.
But I don't agree with it: if pennies are such an overwhelming problem, they could transfer one senior person and hire two assistants to point folks to relevant links, rules and regs. If *they* get overwhelmed? Fine. hire/transfer some more. They need to get over the idea that trading will get back to what it "used to be." Online trading opened the market to the lil guy, and we want/expect the rules to be followed.

I just saw JG's subpoena...why is HE the defendant? Are they having a separate case going against him? and it is from Texas rather than Georgia? Not following JG stuff too closely but was wondering if anyone might be...

I cant imagine that anyone gave him permission for the things he has been posting so im curious about this subpoena. From what ive seen it appears that he is taking the stance as defendant against Rufus but ill wait for the court docs to decide.

I have received subpoenas for cases...to appear as a witness...and the plaintiff and defendant are the names of the parties in the case...
I have never seen any witness in the defendant's "space"...his name would appear in the "body" of the subpoena...but then again...stranger things have happened with CSHD...
**also the volume is high and it is going up and down between 150% and 200%...kinda funny to watch...

Well, id like to speculate that JG is spouting off that he is working with the SEC but in actuality they are inviting him in for "other" reasons. Whatever it is they are doing I hope they are able to sift through the BS carefully.

I would've assumed that either the Ga court would issue it, OR the Texas district would direct him to the Fort Worth office. Then if Ga folks needed to be there, *they* would fly in...

The other interesting tidbit there is that James Gee posted it on Friday. If you believe the Subpoena, Alana signed it on Friday.
THe whole Texas vs Georgia court makes no sense to me.
