no he said it might not need to be halted, and who knows what's going to happen on the 30th when we get the reset. What if we reset and then get listed on naz it'll be a 3 day halt.

I think the question is proving you owned X shares on the 16th. In your case, you would get some free shares - whatever you didn't sell yesterday X 7.

Actually the shares were purchased in late July. His name is on the NOBO list. I am justing asking whether it would be best to transfer now or wait till after the 30th. Just do not want to lose out on the 7X shares. Thanks

I did not have time to set up my brokerage account so I gave some $ to a friend who was also getting some CSHD. So all the shares are in his name. We were going to transfer my share of the shares into my account tomorrow, but I do not want to miss out on the 7X shares. Should I just leave them be and then transfer them after the Oct 30th? Or if I do transfer now, will the extra shares follow into my new account? THANKS

If they are in your buddies name then you may not have been on the list. If you are not you may email CSHD and they'll update it.

I think Mo is onto something...namely the 10-day rule could well be a problem, as I read the regs.

From http://people.csail.mit.edu/jrennie/money/nasdaq_listing_req_fees.pdf:

quote:
The LAS Form, which is available on the “Listing On NASDAQ” page of www.NASDAQ.com, should be submitted 15 days prior to the issuance of securities or 10 days before the
record date for SEC 10b-17 distributions.

10b-17 distributions apply to:
  • Stock split/stock dividend or reverse split;
  • Other distributions in cash or in kind, including a dividend or distribution of any security;
  • Subscription offering or rights offering/poison pill.

To me, "distribution of any security" covers this, even it's judged *not* to be a split...

My understanding is that since it was filed as part of the 8K and 8KA, the reset, that was the notification. It was well publicized. Now the 10 days are the notification that the company was required to do for NASD. NASD could come back with something, I know they have in the past so that is why I will hold. Until I'm sure I will get the distribution I won't sell anything. I also don't want to give the brokers any chance to screw around. don't want to be in the situation of fighting it out instead of being able to decide when I want to take profits. You know let the dust settle.

GLTA
Wally

You're saying the "we choose option C" language (which btw is worded differently than original option c) was filed before yesterday? and, further, that would constitute notice to NASD?

He wanted to catch the mm's off guard! I think he did a good job.. He said we would get $15 a share and we are getting the equivalent or even better. I'm WAY happier they did it this way. It kept all the jacka$$e$ out of the stock who were just in it for the RESET! I think he did a great job of separating the mice and men/women!

I don't know if you can even do that at all--don't we all sign something to the effect that only *I* can trade in *my* account? May be easier simply to tell your pal when to sell, then get the dough from him...

I would take to my broker or even an attorney before doing anything. I'm not sure how you would go about taking shares in someone else's name and putting them in your account. You could be opening yourself up for gifting tax. Be careful.

St Matt - just some adice from a mommy - there are theeting pills at WalMart. I don't remember the name. They are in a pink package & they usually have them hanging in the baby aisle instead if on the shelf. They work awesome!!!! Give baby thoses pills- they dissolve under the tongue, and some ambesol. Do that right before baby goes to bed. About an hour before she goes to bed you can also give Tylenol too- just one dropper full that's it. Baby will sleep good because your taking care of the pain topically & systemically.
Thanks guys...we were doing the Tylenol and ambesol thing, but she was still waking up. I will check out the pills at Walmart...thanks again.
