You know this same thing has been happening in the silver market for some time.. Its interesting for me to see how this affects different markets all the same.

• Establishing uniform "locate" and "close-out" requirements in order to address problems associated with failures to deliver, including potentially abusive "naked" short selling.
• Locate Requirement: Regulation SHO requires a broker-dealer to have reasonable grounds to believe that the security can be borrowed so that it can be delivered on the date delivery is due before effecting a short sale order in any equity security.6 This "locate" must be made and documented prior to effecting the short sale.
• "Close-out" Requirement: Regulation SHO imposes additional delivery requirements on broker-dealers for securities in which there are a relatively substantial number of extended delivery failures at a registered clearing agency7 ("threshold securities"). For instance, with limited exception, Regulation SHO requires brokers and dealers that are participants of a registered clearing agency8 to take action to "close-out" failure-to-deliver positions ("open fails") in threshold securities that have persisted for 13 consecutive settlement days.9 Closing out requires the broker or dealer to purchase securities of like kind and quantity. Until the position is closed out, the broker or dealer and any broker or dealer for which it clears transactions (for example, an introducing broker)10 may not effect further short sales in that threshold security without borrowing or entering into a bona fide agreement to borrow the security (known as the "pre-borrowing" requirement).
• Temporarily suspending Commission and SRO11 short sale price tests12 in a group of securities to evaluate the overall effectiveness and necessity of such restrictions. The Commission will study the impact of relaxing the price tests for a period of one year.13
• Creating uniform order marking requirements for sales of all equity securities. I commend you for trying to fight naked short selling but how do you propose to be successful doing so while so many have failed at it or are still fighting it everyday like Patrick Byrne of Overstock.com?

There is no FTD or naked short selling problem. Repeat after me. There issssss no NSS problem.
You are all just whiners who are angry your stocks didn't go up.
Short selling is a valuable tool to prevent pump and dump scams. If naked short selling happens, it is a case where countering one fraud with another is a good idea.
Does anyone else have a pretty low threshold for these intelligence-insulting examples of the Wall Street/SEC's reasoning?You have to wonder what the hell is going on at the SEC and on Wall Street these days.
Is it not abundantly clear to everyone that can count that the brokers are just printing sales transactions, and then crediting securities entitlements to customer accounts without ever expecting them to be made good? Why not? Who's going to stop them? What penalty are they facing?
Other than the companies who are depressed beyond belief, and the shareholders who paid good money and received NOTHING in return, who's being hurt?

When did it become OK to steal investor money, never deliver squat, and keep the proceeds? That is what the evidence clearly shows is happening. Bonuses on Wall Street have never been bigger, and hedge funds are bloated with cash...where do you think all the money came from? How do they do it, year after year, in a flat market with zilch IPO work, and commissions that wouldn't keep a wino in MD 20/20??

Wall Street is stealing your, and my, money. That's the word for it. Stealing. Simple. They create trades, and don't deliver. It is fraud. It is overt, and they don't ever expect to deliver, because nobody will ever make them. The public are sheep. Idiots that will believe whatever they see on CNBC or read in the WSJ.

I have been busy sending out my email to as many news orgs and "public officials" that I can think of. I also sent links and copies of the Ameritrade PR and the one from last night...that way no one has to "search" for what I am talking about. I'll miss the open but will be back later on...HOLD tight to your shares!

I have to call ameritrade this morning about my shares. I called when the companies name change was going through. They researched my stocks and they were all mine at least that's what they said. I'd just like a little reconfirmation about that.

Not to rain lava on our parade... but how much success has anyone had in making the naked shorts cover? It just seems that they keep shorting this thing to hell because they know they will only get a fine that is miniscule compared to the profits that they have already taken in.
We have to help ourselves.... alert the media, our government, anybody.
Otherwise, these MM's have just stolen millions of dollars from us. It is fraud, theft, and evil at that. We can't let them get away with it. I hope Rufus has some high power friends and more aces in his pocket.... cuz I feel like a little fish in a very big pond, and the sharks rule.
This situation is almost so bad that I feel like the big money will do whatever to protect itself and just walk away.
I just wanted to say that this is for you the shareholders, the investor that is so often left at the hands of the Market Makers profits. God Bless and I really hope and pray that everyone performs good deeds with their money.

If anything a NOBO list is an UNDERSTATEMENT of the shares owned. It only lists those investors who are willing to be identified.

I have written my letter ( well Babes letter) to the appropriate people.. I posted her letter on HSM too. We have to write... write... write...

Only if the SEC cares, and grows some teeth. The shorts sure haven't looked scared yet... I'm not sure this PR will do it.
