Well let me tell you why I think thats incorrect . If the Judge thought Rufus was running a clean business , he would not want this to tarnish it any further . He would have ordered the SEC to refile its paper work when it had more evidence . The Judge felt that the SEC has enough credible evidence to proceed with this but has given Rufus the benefit of a doubt and allowed him until the 7th to provide the proof he claims he has .
As for not showing up with an attorney , my gut says they didn't show up with one because they are cash broke and couldn't afford one.
Oh give me a break!
And once again you talk about this HEARING as if it were a TRAIL!!

Sorry trade, I disagree. His truth has created the problems. The sow cause order is not a two-way street as some have suggested. The SEC has presented its evidence and discrepencies. Now the defendant has to show cause why the plaintiff's case does not hold water. Silence would be real golden now.
Also, what attorneys. He didn't even bring one and if he had an attorney that advised him to confront the SEC w/o one, then I'd fire his behind. Let's be realistic. Also, you mean ignorant people can't be CEOs? Crooks?? May I say Ken Lay.

You don't have a clue...
This was just a "Evidentiary TRO Hearing-" or FACT gathering HEARING... not a trial.
What they do is gather evidence... If the SEC thought a Comic book was evidence then it would be marked as such.
Now if the SEC showed up with nothing at all then the case would be dismissed, they didn't.
They brought their evidence, Rufus brought his.
THAT IS ALL THAT HAPPENS AT A EVIDENTIARY HEARING!
Chartwalker - no disrespect to you but you are wrong .
An evidentiary hearing is only a step in the process but a very important step . This is the step where the Judge examines the evidence and decides whether there is enough there to proceed with it . If the Judge finds there is a lack of evidence , the process stops . If the Judge find there is enough evidence to support the claims the SEC has made , the process goes foward .
I'm not going to sit here and agrue with you guys . I've been involved in lots of legal cases , most of them smaller civil suits but the same basic rules apply .
We have been played ....... Its that simple . Rufus has been lying to us this whole time and painting us a picture of what we want to see . We are screwed but hopefully he's screwed even more !!!

Calm down... everyone claiming to have a law degree... please raise your hand. Now slap yourself in the mouth!!!
Rufas may still have "wonderful" news. He may be vendicated. The SEC wanted proof of ownership, Rufus gave then 10 documents one sealed. And the SEC has the power to say, "Thanks for the information... Now was that so hard?" and remove the complaint themselves if they want too. Fact is we are lagging behind in current info by about 24 hours at this point. I know I would not trust a stock ticker with a 24 hour delay. (Unless it only showed suspended stocks. LOL)
I am not ready yet to say this is the beginning or the end. I am ready to say keep digging folks, and I can't wait for the info that is comming to us tonight. (maybe)

Thesource what is this we stuff? You actually think we believe your are a holder and not a wolf in sheeps clothing? All you do is try to prove why this can't be real. Sorry man but you hold no credit in my eyes. You don't try to prove truth only prove how it is not

source is correct. If Mr. Harris would have brought with him the necessary legal documentation he said he had and would present only to a judge (his words not mine), then the show cause order would not have been issued and there wouldn't be another hearing. If these documents are not produced at the hearing, then you can bet your bottom dollar, the SEC will file criminal charges.

I can understand share holders wanting to believe this is going to turn out alright in the end but you guys REALY should read the SEC complaint and evidence! especialy the "mashburn declaration" not good reading there! the bonds are trading now ( apperently ) and the 5 billion bond may only be worth 700 million plus the agreement to split profits 50/50 on the 500 mil bond and none of them ( according to the SEC ) are wholely owned by CVSU!. this does not look good! IMO!!

YEAH! Like thesource said! The evidentiary hearing is where the judge decides who he likes better. At least, that was his tactic last night. Didn't work, so now on to something else.
Also, what happened to source's claim that he would post nothing else till this was over. Evidently, he has seen all evidence and ruled guilty on this.
Source, you are a basher, plain and simple. You are not wanted here, and I, for one, would like to request that you leave. Or, would Ameriturd dock your paycheck for that?

Actually , I've been self employeed for 8 years and in those 8 years of running my own business , you do end up in court more times than you might think . I've been in court from being sued , suing other parties and other misc hearing from anything like property taxes to laws reguarding my trade and legal issues that limit certain things in my trade . All in all , I have either directly or indirectly been involved in probably over 50 cases . Some of these cases were very straight foward and others got very interesting but you leave each one with a little more knowledge than before .

I did read it and it told me that Mashburn really does not have much experience in bonds.

So you guys actually believe that a judge is going to take all the evidence, read it all, research the law behind it (yes judges do research), come to a decision, and then make an order all in one day? What if this case involved Shell Oil vs Microsoft and the evidence was 300,000 pages of documents? Would that be a one day deal as well?
Of course not. The judge needs time to read and understand all the charges and all the evidence. The TRO is common sense during that time. It basically says "Don't do anything illegal".
Give me a break.
I don't know if Rufus is telling the truth or lying, but I do know that this TRO is not an indication by the court that Rufus is guilty of the charges.

Well if in fact you have been in court that many times and have been sued, then it's not MY opinion now is it? It's an observation to the facts.

Where in the blue blazes in the Mashburn declaration does it indicate anything about his knowledge of bonds. This was his recount of a telephone conversation w/Harris, et. al. Asking questions does not mean you don't know the answers, it may mean you are wanting to see what the other guy knows.

mashburn is the district cheif in the enforcement division of the SEC in atlanta! I am shure he knows a little more about bonds than most posters here! he has an entire office at his disposal and access to more info than we can imagine! maybe you should read it again!!
