Talk Visual Exec Wins $1-Million Judgment vs. Basher

He tagged himself "Pugs" or sometime "Spider Valdez" and he bashed DCI Telecommunications, now trading on the Pink Sheets, even setting up his own chat line on Silicon Investor to bash some more.
But he went too far, a court ruled, when he bashed Michael J. Zwebner, chairman of Talk Visual Corporation (OTCBB: TVCP), with false and defamatory statements about shorting DCI stock.
Zwebner sued and won a $1-million settlement, and a public confession, from Defendant (and Basher) Gary Dobry in the Civil Action No. 98-CV-682-M in the Federal District Court of New Hampshire. The settlement included Co-Defendant David Shepard (alias "Rico Staris").
"I am pleased that this litigation is over," said Zwebner. "I feel vindicated in as much that these posters have come clean and have admitted their false and libelous actions. My family, and my business associates, as well as myself are relieved that all these false, malicious and libelous statements have been exposed for what they are."
"The closure of this case, as well as the action taken by the Securities and Exchange Commission against DCI, Joseph Murphy, and others," Zwebner said, "is a very clear, loud and emphatic statement. It confirms to the public at large the real true facts, the truth, as I have always claimed it to be."
Talk Visual was known as Legacy Software, Inc. in the period between September and December 1998, when the bashers were at work.
In the court mandated statement, Dobry said "I made accusations against Michael Zwebner including false and defamatory statements in relation to his association with DCI and his alleged shorting of DCI stock and his bankruptcy. I now totally and absolutely apologize to Michael Zwebner and his Family for all the pain and suffering and public humiliation I caused him."
Dobry said he was "wholly misled by third parties in the dissemination of this false information. "I came to understand that the promoters and directors of DCI falsely claimed that the continuing fall in the DCI stock price was a result of Michael Zwebner's supposed short selling," he said. "To my embarrassment, I later learned that was untrue."
The judgment stands, but a vindicated Zwebner has agreed not to enforce it as long as Dobry does not attack his or his businesses further.

Internet message boards are popular online forums where people gather to interact in social activity and to share information. Among the most popular of them are stock message boards. Investors and potential investors gather to learn more about a certain stock to enhance their own personal knowledge to better understand their favorite companies. However, even on message boards, everyone is a critic. Some are more bias than others, but none the less, everyone wants to share their two cents. Owners in the company's stock are not the only ones giving their two cents, but also stock bashers (those who post negatively about certain companies for purposes of scaring away new investors and persuading already investors to sell) are posting on message boards and stealing the content quality from actual investors; thus spawning the title of this article "Message Board Marauders".
Bashers just have an incredible desire to know the so called "truth" about companies they don't own. The spend constant hours battling with longs (actual investors in the company) to reveal sometimes non-existent secrets hidden from new investors. Don't let bashers fool you, for they are highly trained and low paid professionals. They know when to post and when to hide in the bushes. Their interrogating minds inquire a certain amount of useless knowledge on companies they don't care to own. Seems like a utter waste of time, but for them it's just another day at work.
Stock bashers infest stock message boards with ignorant postings about how bad a company is. They steal the tranquility from once peaceful and friendly message boards and turn them into wall street war zones leaving many new investors running for cover and old investors preparing to fight back. Bashers almost always win the argument because they don't post the truth. They can ramble on about how a company is hiding something or about how much their stock is going to fall tomorrow. Longs cannot prove them wrong, because the information the bashers give is false and therefore cannot be proved or disproved.
Bashers work in groups so they have even more of an influence on new investors. New investors should never use message board users are their primary source of research. The best thing any new investor can do to better their knowledge on a certain company is to visit the company's website, look at their stock profile, and read all of the important news releases they can find. This strategy works best when applied to penny stocks. Most large cap stocks already have analysts covering them and the media following their trail, but researching penny stocks can be very difficult and sometimes confusing. New investors should use message boards are secondary means of research, and they should be aware of who is bashing and who is pumping. Common sense plays a role in discovering who is who in the message board game.
If your an experienced investor in a given company, then the best line of defense for defeating bashers are to let others know that their stock is being bashed and by who. Stock bashers hate is when their identity is revealed and they try their best to lie about who they are. Please post intelligently and responsibly.

What is interesting is that people who post on these boards do not even know basic case law or familiar with recent SEC actions for said behavior. This is not a free-for-all. That is why when people say NDOL is a "pump and dump stock scheme"; "management is dumping shares"; "North-West Oil Group is a secretive politburo connected company who would not be allowed to operate in the United States"; etc, etc ad infinitum - that these postings have extreme and often deleterious impacts on not just the stock, but the company and their personnel.
That is why I have made it a point to make Nord Oil counsel and others aware of what is being posted about Nord Oil, North West Oil Group and now Aurus Corporation. The people posting such allegations have called me a "cry baby" who runs off to the SEC - so be it. People need to take responsibility for their actions. If I were part of management at any of these companies then I would want to know what was being said on internet boards that people rely upon for information. I would want to know if people were calling me and my organization a fraud.

I am not a basher. A good chunk of my "stock money" is in this, so obviously I'm hoping it does well. Just wanted an opinion on an honest observation.

I have a suspicion that many young and nieve' posters do not do there homework...
Thru out the day on Bloomberg and CNBC there is critical analysis on stocks.. The week-end talking Heads shows are on many Cable and Standard network channels..
Understanding Critical analysis is mandatory in the Adult World of Traders and investors..
You have never seen a true Basher, if you think Purl Gurl is a paid Basher..
What you have in reality is an analytical adviser for free.

Newbie7, where did you find a financial report on the NORD website? All I can find is financial projections which are meaningless lacking any verifiable factual basis.

Darn right. You should listen to some of the AM radio talk show hosts if you want to hear some really harsh words!
Critical Thinking is one of the most important abilities a person can develop, as is developing an ability to think "outside the box."
Very many times a small hidden clue can be found within line after line of fluff and flitter. Those tiny clues can make all the difference between profit and loss.
Checking numbers is equally important. This is easy to do. When numbers do not add up, old fashion common sense tells you,
"Something is not right."
When board participants provide wild claim after wild claim and accuse anyone who disagrees of being a basher, that tells you,
"Something is not right."
Look at what the pump and dump scam artists did over in the GHLT thread. Those crooks, who are posting on almost all stock boards, those crooks not only stole people's money, they indirectly caused hundreds of thousands of dollars in losses for tens of thousands of families all over America and beyond and I do mean "families" most strongly.
Most often, those who are quick to accuse another of being a basher, who spend much time trying to convince others a person is a basher, those people are almost always paid pump and dump scam artists out to defraud anybody and everybody.

A paid Basher zero's in a stock and stays there..
Hold em, check the threads those you accuse are all over the place...Some of us are very busy finding other possible stocks for ourselves and others to discuss....
