I predict that this is the week MDVX shares eclipse previous highs in the 2.05 range going on to make subsequent new highs while establishing a new and higher trading range.

I would not be surprised to see a more explosive move resembling the one ONT made recently going from 1.50 to 3.80 in the last month or two.

Regardless, looking for new highs and a strong leg up as I believe some fund players are now starting to really get involved with the shares believing they are an eventual takeover target in the red hot online vido and audio space which has seen a high degree of consolidation as of late.

Nice commentary regarding MDVX after the close on Market Wrap show on ***. Shares pulled back 13 cents today following recent strength just shy of new multi-year highs.

On Steve's Kanaval's show today he mentioned that Modavox was his number one pick in the media sector. Also mentioned it was down today which made it an even better buy. Here is his bio.

Steve Kanaval was an original member of Morgan Stanley Futures Task Force at Chicago Mercantile Exchange. Steve was also President and founder of Chicago Arbitrage Group and a Manager of multi billion dollar portfolios during the internet boom in San Francisco. Steve also acted as Senior VP in US public markets including Investment Banking & Hedge Funds.

Steve has fifteen years of P&L reporting and management experience with portfolio's ranging from 1 million to 300 million. Steve spent 5 years as a member of advisory boards to publicly traded companies and private companies. He was most recently Director of Research at Knobias.

Stating that Modavox is his top pick in the media space is pretty bold. It's clearly a nice testimonial from someone who knows the space well, recognizes quality management and understands the dynamics of investing in emerging micro-cap situations.

Company Reports Record Year End Revenues; up 88% Year over Year


PHOENIX--(BUSINESS WIRE)--Modavox, Inc. (OTCBB:MDVX - News), Internet broadcasting pioneer in producing and syndicating online audio and video, yesterday reported its year end results for the fiscal year ended February 28, 2007.

The company reported record revenues for the twelve months ended February 28, 2007. Revenues increased 88% to $2,659,992 compared to $1,411,553 for the twelve months ended February 28, 2006. The company recorded a net loss for the year ended February 28, 2007 of $554,082, this net loss included non-cash expenses of $691,685, consisting of depreciation and amortization expense $360,011, the valuation of warrants issued for services $287,674 and stock option expense $44,000. Non-recurring merger and reorganization expenses were $188,259, consisting of legal expenses $63,259 and separation payment to the former CEO of $125,000. Operating expenses increased only $40,995, despite a $1,248,439 increase in revenues.

DALLAS (June 14, 2007) - Think about the way advertisers have used the spray and pray method of advertising. The Internet has changed the way advertisers can target a specific demographic, and a new term is circulating in the media space which is creating a disruptive technology that is getting the attention of everyone in the industry. As the media space continues to explode in every market cap, this disruption has resulted in media consolidation across the board. Need examples? Look at Sam Zell's purchase of the Tribune Company (NYSE: TRB), Rupert Murdoch's bidding for Dow Jones (NYSE: DJ), Thomson's (NYSE: TOC) recent purchase of Reuters (Nasdaq: RTRSY) and a silent bid by private equity on the table for Bloomberg.

Clearly, the media space is as hot as any sector on Wall Street. The stark reality is that Wall Street analysts covering the media space have undervalued all assets because of this simple supply and demand function. No longer are there three mediums for content delivery; there are now six delivery platforms for content. It has quickly evolved from broadcast TV, cable TV and radio to broadcast TV, cable TV, radio, PC, laptop and cellular phone services. This means there is the same amount of content available and double the demand, in turn, making all existing content immediately more valuable.

What this means is billions of dollars spent on media-driven advertising have more places to run ads. For example, ESPN just became worth twice as much, and all IPTV content on the Internet just became more valuable. This is the disruptive technology the industry has been squirming about since 2001. Look out Google (Nasdaq: GOOG), look out AOL (NYSE: TWX) ... you may have an issue.

A subtle and somewhat still under-the-radar player in this whole picture is Modavox Inc. (OTCBB: MDVX), ands many industry experts are now just beginning to wonder if some mega market cap Internet giants have been infringing on their patent for years now? Today, Modavox announced that they were just awarded a new patent covering Advertising and Streaming Media Delivery technology, one of the hottest and talked about technologies of the time as advertisers seek to monetize online ad dollars through streaming advertisements and geo-targeting of consumers. In this communication the USPTO also provided a favorable indication toward one or more additional pending patent applications relating to Modavox's core technology, although some interplay with the USPTO remains before Modavox obtains a final approval for any additional patents.

Partisanship Put Aside to Give Internet Access to Blind

It’s not unusual for someone in business to ask a member of Congress for help. But when Craig Columbus got together with Rep. J.D. Hayworth to give a boost to an Arizona start-up, the partnership was also a happy contradiction of our era’s nasty partisanship.

Columbus, you may recall, challenged Hayworth for his seat in 2002. That didn’t matter as Hayworth was happy to be an early adopter of Web streaming technology that gives blind computer users access to the Internet. Hayworth will use the prototype technology on his congressional Web site.

The company behind the software is AudioEye, which was started in 2002 by University of Arizona grads Nathan Bradley and David Ide. Columbus, who now manages a hedge fund as vice chairman of Greenbook Financial Services, provided seed capital and guidance to the start-up. AudioEye will let the blind or people with poor vision bypass buying costly hardware or software. It’s free to users when the Web site buys a license.

Range is getting tighter

The seven-month ascending triangle (bullish) continues to tighten. Meanwhile, a symmetrical triangle (also bullish) has been developing the past two months. In other words, the range is getting tighter, which means we could be getting close to the point of breakout. Both patterns indicate a strong move to the upside once the $1.90-$2.00 range is taken out. That $2.50 price target by the covering firm should easily be met, as I see the mid-to-high $2's as a possible upside target in the coming months.

About Pat Summerall

Pat Summerall played his pre-college football at the University of Arkansas,
where he was recognized as an All-State selection in football, as well as
basketball. He also earned varsity letters in both baseball and tennis.
Summerall played college football from 1949 to 1951 at the University of
Arkansas, where he played the defensive end, tight end, and place kicker
positions.

Summerall spent 10 years as a professional football player in the National
Football League, primarily as a placekicker. The Detroit Lions drafted Summerall
as a fourth-round draft choice in 1952. Summerall played the pre-season with the
Lions before breaking his arm, which ended the year for him. After that season,
he was traded and went on to play for the Chicago Cardinals from 1953 to 1957

Believe this company is literally sitting on some of the most valuable intellectual property in the entire internet space which is being widely infringed on forcing an eventual acquisition of the company.

Stockman...I still have some free shares of MDVX. However, I recommend hold off on investing in the company until it is breaking that 2.05 barrier. I told ya that like 7 months ago. You could have put money in a CD and made some. I dont know when it will break that 2.05.

I am 100% sure it will one day!

Wasserman Morris Reiterates Speculative Buy on MDVX with $2.50 target.

We reiterate our Speculative Buy and our $2.50 per share price target. In as much as Modavox, Inc. (MDVX) delivered another round of double digit top-line growth, we believe the sharp growth anticipated is slated for the second half of fiscal year 2008 (2HFY08), starting 08.31.07. Hence, the results have not impacted our projections for the Company. Further, while the new contract mix duration is extending outward with more predicable sales traction, we expect the short term impact will engender wider early losses given the expenses are recognized during the period, while the sales will be largely a deferred asset. For example, in 1QFY08, MDVX sold more 26, 39 and 52 week contracts than they did 13 week contracts. The two edge sword is that Modavox should have reduced contract attrition and more consistent cash flow, yet, the newer contracts will have less immediate sales (offset with an increase in deferred revenue asset). Furthermore, the expenses will be front-loaded, resulting in a near-term gross & operating margin reduction.


Modavox’s Interactive Media Division is still lacking growth catalyst, yet from these efforts and filing continuation with the United States Patent and Trademark Office (USPTO), the MDVX was awarded a new patent and favorable indication on a third patent during the first week of the Company’s second quarter. The Interactive Division also shows promise with scalable revenue potential in E-learning projects, such as University of Phoenix, McGraw-Hill and Garnett.


MDVX has increased its presence in Internet Talk Radio, with its agreement with Pat Summerall to produce and deliver a weekly hour long Internet sports talk radio show beginning September 5, 2007. In the suit, Modavox asserts its claim that Tacoda is infringing on United States Patent No. 6,594,691, "Method and System for Adding Function to a Web Page," and may soon issue claims from at least one additional patent. Modavox is seeking injunctive relief and as yet unspecified damages stemming from Tacoda's infringing activities.

Unknown Modavox Targets AOL's Tacoda to Cash in on Patent

Tacoda's pending acquisition by AOL may have been a catalyst for a new patent infringement suit filed against the behavioral targeting firm. Modavox, an online broadcasting media production firm-turned-software provider, has over the past few months sought to identify patent infringement suit targets, of which Tacoda appears to be the first.

Modavox Thursday announced it had filed a suit against Tacoda in US District Court for the Southern District of New York, claiming the behavioral targeting firm has violated its patent on a

"Method and System for Adding Function to a Web Page." The so-called business method patent covers a technology that serves up customized multimedia content and advertising to Web users. Modavox, a public company, was granted the patent in 2003 under its former name, SurfNet Media Group; the patent application was filed in 1999.

"We really were focused on Tacoda a long time ago when they came out with their whole business model," said Modavox CTO and Chief Product Officer Nathaniel Bradley. "Tacoda is one of many potential infringers out there," he added, noting Tacoda competitors such as Revenue Science, AlmondNet and others are also possible lawsuit targets. "It's impossible for us to sue everybody," he said.

Tacoda is reviewing the Modavox complaint, according to Tacoda CEO Curt Viebranz, who said the company does not comment on active litigation.

In May, Modavox hired intellectual property law firm Fox Rothschild, LLP to represent the company in patent enforcement efforts. The tech outfit commissioned the person behind the patent in question, Andrew Burgess, to study potential infringement suit targets in March. Modavox aims to "create revenue around licensing," said Bradley.

Bradley said he believes Tacoda considered Modavox's technology when developing its own behavioral targeting system. "We have a hard time believing…we weren’t part of their due diligence, their thought process, along the way," he said.

Though Bradley stressed Tacoda has been "on our radar" from the "outset," he admitted AOL's recent agreement to purchase Tacoda got the lawsuit ball rolling faster. "With that filing we felt a sense of urgency," he said. AOL agreed to buy Tacoda last month for $275 million to bolster the behavioral targeting capabilities of its Advertising.com ad network and on its own properties. Tacoda launched in 2001 and refers to its technology as patent-pending.

"Industry consolidation gives patent owners larger and deeper pockets to sue…even though financially stronger defendants also increase the odds of better-funded litigation defenses," said marketing tech law pundit Eric Goldman, Assistant Professor at Santa Clara University School of Law.

Last year Modavox was pondering the viability of a patent infringement revenue model, according to a November 2006 SEC filing stating, "We have recently been approached by a third party to discuss whether it is feasible to pursue suspected infringement of our Modavox Central patent. We currently do not know whether infringement has occurred or the conditions, if any, under which we might pursue this suspected infringement."

It appears as though Modavox has been interested in boosting its interactive software industry presence over the past year or so. The company, which opened a new Interactive Media Division facility in Las Vegas in March, purchased Kino Interactive early last year, adding to its rich media delivery capabilities. v"We're a bit of an unknown," Bradley said, adding, "We haven't spent any money on PR or marketing."

The company provides audio and video content and ad delivery services to Gannett's AZCentral.com and Detroit Free Press, among other sites. Coincidentally, Tacoda enabled behavioral ad targeting for Gannett's USAToday site until discontinuing its publisher-side targeting service.

Since the US Patent and Trademark Office began awarding business method patents to the likes of Amazon.com, eBay and Priceline.com, such patent filings have been increasingly subject to controversy. The patents are used for technologies for things like data processing, and even education and training. In 1999, Amazon was awarded a patent for its "1-Click" online transaction system, and soon thereafter it sued Barnesandnoble.com for infringing on the patented system.

Local search site Local.com was awarded a patent last month covering a method for voice and mobile directory assistance. The company said it will look into charging competitors with patent licensing fees.

Expect more efforts to enforce patents, said Goldman. Noting a general increase in patent litigation, he told ClickZ News, "I would anticipate more patent enforcement even without industry consolidation."

What Digg is creating and intends to monetize for that "suggested" $150 million is exactly what Modavox already has in its Voice America and World Talk internet radio network.

As you mentioned, at last count Modavox's VA and WT radio audience of unique visitors was already in excess of 5 million, it's likely much higher currently as that figure was prior to adding many new hosts and some recently added quality content over recent months. I expect that number to be well on its way to the 10 million unique visitor count in forthcoming months. With a doubling of unique visitors, so doubles the intrinsic value of that division of the company and so doubles the amount of dollars someone might look to acquire it for.

I said it just yesterday, I stated the internet radio division of Modavox is worth a minimum of $3 a share by itself and that is an extremely conservative number based on the price paid for YouTube and even the potential price of Digg. If you simply use Digg as the example, and assume they had the exact same unique vistor count despite Digg having less than VA and WT, you'd get an approximate $5 per share valuation. $5 a share excludes the patent portfolio which I believe to easily be worth a multiple of the current market value and excludes the interactive division which I expect to gain real significant traction over the balance of the year with its scalable enterprise communications and e-learning platform combined with it's sizeable margins.

What Modavox has just in its internet radio asset is precisely what advertisers want. They want rapidly expanding niche audiences with highly specific interests which can be accurately defined and directly targeted to. I don't believe there is any better audience capable of being monetized by online advertisers than that of VA and WT radio. Better than that, Modavox itself owns the patented IP which helps facilitate geo-targeting and behavioral targeting which both serve to increase advertisers ROI on their add dollars.

When you get a moment, take a good look at the compiled and posted stats in the Wasserman report on internet radio. Look at the demographics, time spent on line, purchasing power and the average socio-economic status of the participants. I believe that info is in there. If mistaken, I know it can all be found online. It's compelling info and speaks directly towards the viability and value of Modavox's internet radio asset in the eyes of big online advertisers. To compliment that info, just look at the projected growth in general of online advertising dollars knowing what the advertisers goal is as discussed above. The stats simply couldn't be more compelling in our favor.

A parting thought, thanks to Mr. Blodget, we now know that Tacoda does little in the way of revenue. Knowing this, it's clear that AOL wanted them and bought them solely for their "targeting" technology and the value it could bring to their online advertising strategy. We know AOL believed $275 million was a fair price to pay for the technology they clearly want to OWN and LEVERAGE.

Why?

"According to eMarketer (June 2007), the behavioral targeting market is set to increase to $3.8 billion by 2011, from $350 million in 2006."

and...

That's why!

But what we also recently learned is that Modavox believes that Tacoda's "patent pending" technology, that same technology worth $275 million, is actually based on their already "patented" technology. Let's assume that Tacoda is in fact infringing, which I already believe them to be, then can we also assume Modavox and it's technology is also worth that same $275 million to AOL or someone else?. No trick question here my friends, the answer is clearly YES! The technology itself is what is being bought, it's worth a fortune or at least $275 million and it's either us or Tacoda that owns it.

Just for kicks and giggles, take your calculator, take $275 million and divide it by Modavox's outstanding share count, roughly 35 million currently, and see what you get for a "hypothetical" per share value of Modavox if this technology is proven to be owned by them. This is the clearest example and confirmation of my long standing view that the technology at the heart of both Modavox and recent discussions is worth a significant multiple of Modavox's current capitalization.

For all these multitude of reasons and more, Modavox remains my top idea with a year end target of $4-$5 fully expecting an inevitable liquidity event in the form of the company being acquired by one of many companies.

(Second Patent Affirms Modavox's Leading-Edge Role in Web Processes Such as User-Based Customization of Online Content Patent No. 7,269,636 Ratifies Scope of Claims and Further Defines Modavox Breakthrough Inventions)


PHOENIX, Sep 11, 2007 (BUSINESS WIRE) -- Modavox, Inc. (OTCBB:MDVX), an
Internet broadcasting pioneer in the production and distribution of online audio
and video, announced that the U.S. Patent Office today issued U.S. Patent No.
7,269,636. The patent refines the legal definition of Modavox inventions with
claims that accurately reflect how the concepts taught by the foundational U.S.
Patent No. 6,594,691 "Method and System for Adding Function to a Web Page" are
implemented in state-of-the-art delivery infrastructure and delivery practices
seen in the marketplace today.

The new patent leads to a modified complaint filed today asserting the new
patent in the infringement case against Tacoda, Inc., pending in the Southern
District of New York (Case No. 07-CV-7088).
