The Fight Network.....Broadcasting Decision CRTC 2005-578
Michael Garrow, on behalf of a corporation to be incorporated Across Canada Application 2005-0253-5 Public Hearing at Charlottetown, Prince Edward Island 3 October 2005 The Wagering Network – Category 2 specialty service In this decision, the Commission approves an application for a broadcasting licence to operate a new Category 2 specialty programming undertaking. The application 1. The Commission received an application by Michael Garrow, on behalf of a corporation to be incorporated, for a broadcasting licence to operate a national, English-language Category 21 specialty programming undertaking to be known as The Wagering Network. 2. The applicant proposed to offer a service that would consist of programming dedicated to all aspects of the gaming world in Canada and abroad. It indicated that the service would not carry live sports events and that it would simply refer to sports events from a gaming perspective. Sports highlights would comprise no more than 10% of the programming schedule. The service would also offer a sports news ticker providing up-to-the-minute scores and results from amateur and professional sports. 3. All of the programming would be drawn from the following categories set out in Schedule I to the Specialty Services Regulations, 1990: 1 News; 2(a) Analysis and interpretation; 2(b) Long-form documentary; 3 Reporting and actualities; 5(b) Informal education/Recreation and leisure; 6(a) Professional sports; 6(b) Amateur sports; 7(a) Ongoing drama series; 7(b) Ongoing comedy series (sitcoms); 7(c) Specials, mini-series or made-for-TV feature films; 7(d) Theatrical feature films aired on TV; 7(f) Programs of comedy sketches, improvisations, unscripted works, stand-up comedy; 7(g) Other drama; 9 Variety; 10 Game shows; 11 General entertainment and human interest; 12 Interstitials; 13 Public service announcements; and 14 Infomercials, promotional and corporate videos. Intervention 4. The Commission received an intervention from CTV Television Inc. (CTV) commenting on the applicant’s proposal to air sports programming drawn from categories 6(a) and 6(b). Among other things, CTV is the 100% indirect owner of The Sports Network Inc., the licensee of the specialty service known as The Sports Network (TSN). 5. In CTV’s view, the sole purpose of the applicant’s request for authority to air sports programming is to enable it to offer a sports news ticker given that the applicant stated it would not broadcast any professional and amateur sports. CTV indicated that, assuming this is the case, it would have no objection to the applicant’s proposals provided that this effect was imposed as a condition of licence. CTV also requested that the Commission impose a condition of licence requiring that the authority to carry category 6 programming be limited to "sports programming consisting of alphanumeric text content containing sports information from a gaming and wagering perspective." Finally, CTV submitted that the application should be denied if the applicant were not willing to accept such a condition of licence. 6. The applicant did not reply to the intervention. Commission’s analysis and determination 7. With regard to the concerns expressed by CTV, the Commission notes that, as one of the conditions of licence set out in the appendix to this decision, the applicant is prohibited from offering any coverage of live sports, while sports highlights are limited to a maximum of 10% of the program schedule. The Commission is satisfied that these restrictions are sufficient to prevent the service from being directly competitive with TSN. 8. The Commission is satisfied that the application is in conformity with all applicable terms and conditions announced in Introductory statement – Licensing of new digital pay and specialty services – Corrected Appendix 2, Public Notice CRTC 2000-171-1, 6 March 2001 (Public Notice 2000-171-1). Accordingly, the Commission approves the application by Michael Garrow, on behalf of a corporation to be incorporated, for a broadcasting licence to operate the national, English-language Category 2 specialty programming undertaking, The Wagering Network. 9. The licence will expire 31 August 2012, and will be subject to the conditions set out in Public Notice 2000-171-1, as well as to the conditions set out in the appendix to this decision. Issuance of the licence 10. A licence will be issued once the applicant has satisfied the Commission, with supporting documentation, that the following requirements have been met: an eligible Canadian corporation has been incorporated in accordance with the application in all material respects;
the applicant has entered into a distribution agreement with at least one licensed distributor; and
the applicant has informed the Commission in writing that it is prepared to commence operations. The undertaking must be operational at the earliest possible date and in any event no later than 36 months from the date of this decision, unless a request for an extension of time is approved by the Commission before 5 December 2008. In order to ensure that such a request is processed in a timely manner, it should be submitted at least 60 days before that date.

I called Holladay of SNYY and found out that Holladay had to reissue the divies yesterday to prevent/stop/curtail NSS problems. I really do not know how that one works, but it has to do with matching shares.
The guy I spoke to was extremely curt, I assume because everybody and their brother has been calling him today. Poor Chap! He did say it may take up to 6 weeks and or 2 months to straighten this shizt out. He kept telling me you cannot cash them in for a year anyways and I said thats not the point. I told him we're concerned about the NSS crap and thats when he said he had to reissue the shares again yesterday for that reason. He said I have told you more than I should have and I have nothing more to say....good-day..and I said thanx!
I tried to get in touch with Sandy at 416-918-2209 several times and all I got was the machine. I did leave a message that I wanted to talk to him about the status of the divies and its relation to NSS. So if/when he calls me back I'll share that with you all.
I tried to reach the General Council's Office at the DTC 212-855-3240 ext 3310...but they're closed for the day.
In the mean time, I would suggest letting the SEC know the MM Nazi Muffins are hoarding our money.

You CAN sell your shares in BKMP anytime you want to. Period. End of Story!!! As for SNYY.. if you owned BKMP at the time of the divi it is on record and they are yours no matter what you do. But.. hey.. here's something you aint ever heard before -- SNYY is not worth anything. Please.. for your own sake.. do not place any of your future judgments on the divi. Place them on the DD you do on the company.

If you want SNYY dividends, you cannot sell BKMP shares yet. There is a war going on with the dividends right now and that war is waged by the MMs. They have oversold BKMP shares and someone needs to purchase more SNYY shares...that being the MMs because they shorted.
Everyday the divies are not in your portfolio now, is a day the MMs can shake the tree to get shares back, thus no reason to match that share up with an SNYY dividend. This is in despite of rec-date which only made a share 'eligible'. To own it, you must have the matching 6 BKMP shares in your portfolio when the dividend arrives. Thats the T+ regulation with pay-date exclusive to dividends.
The problem is between Holladay(SNYY) and the DTC, they keep going back and forth with matching problems. While they go back and forth, the MMs almost in a frenzied state will try to shake the tree...this is why we want those divies...so the MMs get nailed and stop manipulating the pps scaring investors.
Best thing to do right now is file the complaint to the SEC as you see it...so we can get on to smooth sailing again. The complaint is very easy to fill out and takes a couple of minutes to bring it to the SEC's attention.

They should be forced to give us not only the actual authentic shares, but the dividend that was due, even if this means that they may be out substantial sums, since SNYY trades at over a dollar, and the dividend was 1 SNYY for every 6 FCDH held. If there was a substantial naked short on this stock, then they are truly in trouble, but at the very least must make sure to give the brokers the authentic shares, as well as the dividends that are due to make ammends to the inconsistancies in the shareholders brokerage accounts, especially E*Trade and Scottrade. Thank you in advance for your time, and I look forward to hearing more on this matter in due fashion.

Digdough.. sorry for the bad info regarding selling shares. I was relying on past information that had been discussed. Rasica.. thank you for setting the record straight. That said, I am now somewhat confused - which, unfortuantely, happens a lot. Not that I plan to sell, but does this mean.. let's say.. BKMP goes on an incredible run sometime next week offering folks a chance to double their money. It sounds like we've got a difficult decision.. sell and lose the gains.. or hold.. and wait possibly a couple of months for the dividends. Kind of think the company should have posted something about that. All I remember them saying was.. if you own stock as of such and such a date you will be getting a dividend.

Here's a post from luvtrad1 and I have made similar posts as well this morning. It seems to me that what you have outlined above is a remote possibility. I believe we will be contending with the MMs for the next 6-8 weeks, who will be shaking the tree to scare shares out of us. This is so they can cover their NSS and not have to buy SNYY shares to match with BKMP. They are in very serious trouble here.
Of course this our honest opinions, SEC needs to investigate it.
Ha Ha Ha, I love this response, wow are we a bunch of idiots if we buy this krap. Four to six weeks is absurd and that is the time frame the mm's are looking for in order to cover their naked short sales. They are counting on us to just sit back and take it while they play manipulation with the stock.
Look, the news yesterday should have at the very least created a pop in the share price and what happened? NOTHING, why, because our friends are holding it down, period.
With all due respect to the posters here who are trying to bury this dividend issue and trying to convince people that this is not a real issue, my advice is give it up. I for one feel that pressing the dividend issue is the only way to make these people pay up and get out of the way.
Don't forget, many of the brokers are also mm's and will try anything to get us to sit back while they clean up their mess.
In my opinion, not only should we be pressing this issue first thing Monday morning, but we should be pressing much harder than we ever have.
It is one of the only two ways this will get resolved. Your other choice, in my opinion, is to let the mm's screw us for "four to six" weeks.

I don't want to say that Rasica is wrong, because what he has been saying is not completely wrong, but take it with a grain of salt.
He is right in that NSS is what is holding up the divi transfer. There is no other explaination for how the transfer agent has more eligible shareholders than shares to distribute of SNYY.
But saying don't sell or you won't get your divi's is just one extreme side of a complicated knot of rules and opinions. I myself sold last week well after we should have received our divi's. I fully expect to get my shares even though I currently do not own BKMP and have started sending messages in to my broker to make sure I am not forgotten.
If I am skipped over, the reason I was not paid my divi shares has nothing to do with me and my holding, rather it has everything to do with those who messed up the system. I will not allow myself to be screwed for what someone else should be taking responsiblity for. Even if I have to start stepping on some people
What Rasica is suggesting by holding is the safest possibility. With shares in hand no one can say you aren't due your divi's. The date is past however in which you should be able to sell and still be a shareholder of record due the dividend.
If you hold: you get your divi's.
If you sell: you might have to get a little dirty fighting but you will still get your divi's. At this point the SEC regulations are actually working for us.
BuyTex, if you read this could you find your posted comments about what the SEC guy told you. I trolled for about a 20 minutes but don't have any more time to find it. Otherwise I will find it tonight when I get back.
