Deputy U.S. Attorney General nominee linked to porn industry


Washington D.C., Feb 5, 2009 / 06:49 am (CNA).- President Barack Obama’s selection of David Ogden to become Deputy Attorney General is being criticized because of Ogden’s links to the pornography industry.

A brief from the Chicago-based pro-family group Fidelis reports that Ogden has represented pornography businesses such as Playboy Enterprises and Penthouse Magazine.

He opposed the Children’s Internet Protection Act of 2000 as counsel of record for an amicus brief supporting the American Library Association in a case that challenged mandatory anti-obscenity internet filters in public libraries.

In the 1986 case American Council for the Blind v. Boorstin, he successfully sought a court order forcing the Library of Congress to use taxpayer funds to print Playboy Magazine’s articles in Braille.

Ogden also successfully challenged laws requiring pornography producers to personally verify that models were over 18 at the time their materials were made. According to the Fidelis brief, he argued that the decision would “burden too heavily and infringe too deeply on the right to produce First Amendment protected material.”

In other areas, Ogden has argued for homosexuals in the military and an unlimited abortion license.

In an amicus brief for the 1992 Planned Parenthood v. Casey decision which reaffirmed Roe v. Wade’s mandating of permissive abortion laws, Ogden argued that abortion “rarely causes or exacerbates psychological or emotional problems.”

“The few women who do experience negative psychological responses after abortion appear to be those with preexisting emotional problems,” he continued.

He argued that evidence shows abortion is more likely to make women “experience feelings of relief and happiness” and claimed childbirth and childrearing or adoption may pose “concomitant (if not greater) risks or adverse psychological effects” compared to the effects of abortion.

In a Wednesday press release, Brian Burch, President of Fidelis, called Ogden “a hired gun from Playboy and ACLU.”

“Ogden’s record is nothing short of obscene,” he charged, adding: “David Ogden has collected checks from Playboy and Penthouse to fight reasonable protections for parents and children from pornography.”

“He can’t run from his long record of opposing common sense laws protecting families, women, and children. The United States Senate has a responsibility to the American people to ensure that Mr. Ogden’s full record is fully reviewed before any vote on his nomination.”

“A vast majority of Americans support parental notification before a minor’s abortion and protecting kids from Internet pornography in our libraries,” Burch continued. “Yet David Ogden has fought tooth and nail against these common sense laws protecting our children from harm. At a time when America’s families are under increasing assault, Mr. Ogden is a dangerous choice for a position whose responsibilities include the enforcement of our nation’s laws.”

According to a July 2008 essay in New Yorker Magazine Ogden is not the only one with ties to the pornography industry.

The essay reported that Christine Hefner, who then headed Playboy Enterprises, played a role in supporting Barack Obama’s political career as early as 2002. Her support began after she met him at a gathering of an influential Chicago women’s group called Ladies Who Lunch.

“I was very proud to be able to introduce him during the Senate race to a lot of people who have turned out to be important and valuable to him, not just here but in New York and L.A.,” Hefner told New Yorker writer Ryan Lizza.

“I try and think about people who I think should know him,” Hefner said.

the FBI is doing it's job... the raid last week was in the former offices of the appointee, but not for or after the appointee.

there's corruption everywhere. and the dems are not immune any more than the GOP...

the question is will the DOJ do it's job or not..

under Bush? the DOJ became a political tool... Gonzalez should prolly be prosecuted for some of the things he did. we have evidence here (thanks to you) that Obama is not telling the FBI to stay away...

rush was defended by the ACLU on the drug charges. they believed his medical records were private. IMO, his rants about how awful teh ACLU is are the reason they should have ignored his case...

they will defend him because they beleive in principles and not personalities..

we live in the age of the cult of personality and principles seem to be a thing of the past....

WEST PALM BEACH, Fla. — Talk radio host Rush Limbaugh (search) probably never expected the American Civil Liberties Union (search) to become one of his staunch supporters.

But the privacy rights group was on his side Monday when its Florida branch filed a "friend-of-court" motion on behalf of Limbaugh arguing state officials were wrong in seizing his medical records for their drug probe.

"For many people, it may seem odd that the ACLU has come to the defense of Rush Limbaugh," ACLU of Florida Executive Director Howard Simon said in a released statement.

"But we have always said that the ACLU's real client is the Bill of Rights, and we will continue to safeguard the values of equality, fairness and privacy for everyone, regardless of race, economic status or political point of view," Simon said.

The ACLU contends that state law enforcement officers violated Limbaugh's privacy rights by taking possession of his medical records as part of their criminal investigation into the commentator's alleged "doctor-shopping" to feed his prescription-drug addiction.
Investigators seized the records last month after discovering that Limbaugh received more than 2,000 painkillers, prescribed by four doctors, at a pharmacy near his Palm Beach mansion.

The ACLU said it was trying to "to vindicate every Floridian's fundamental right to privacy by ensuring that the state be required to comply" with the law.

I disagree with you on that one cow...

Obama's organizing history may give few clues about what policies he would pursue as President, but Obama the presidential candidate still shows his roots--a faith in ordinary citizens, a quest for common ground and a pragmatic inclination toward defining issues in winnable ways. Even when Obama was an organizer, Augustine-Herron told him he would be the nation's first black President. Now the Rev. Alvin Love, whom Obama recruited to DCP, looks at his candidacy and says, "Everything I see reflects that community organizing experience. I see the consensus-building, his connection to people and listening to their needs and trying to find common ground. I think at his heart Barack is a community organizer. I think what he's doing now is that. It's just a larger community to be organized.

heres a little more..

So what exactly would Obama's critics do differently? Nothing on the bailout side. Instead, they have settled for carping criticism of the stimulus package, playing games by nitpicking lesser-cost programs while ignoring the big items that most governors, be they Republican or Democrat, eagerly want. The great fear of the GOP seems to be that some of the stimulus program might actually prove helpful to struggling Americans, but the Republicans can't just come out of the closet and say so.

What they have picked up on instead is that Obama's tax cuts provide some redistribution of income to favor the rapidly disappearing middle class at the expense of the super-wealthy, who have profited wildly from Bush tax cuts. Which brings us back to Gingrich's complaint that Obama is importing European socialism. If that means a system of governance in which a robust middle class is rewarded for work with a strong social safety net supported by higher taxes on the most affluent, well, let's get it on.

the GOP took over and the average household income in America went down.
that's EVERYBODY...

the top 1% household income went up 300% but overall everybody's income went down... the top 1% whose income went up kept the overall decrease from being even worse. then, even they lost almost half of their savings...

well lesseee? Obama has been in office for what? 55 day or so? i stick to facts as much as possible.. it's a wee bit soon to be deciding how he's done.. or if what he's done will help..

my general attitude is that the govt can't really help th e oconmy, but they can hurt it bad. and Bush's 8 years of so-called conservative policy destroyed it

You're kidding - right? It's certainly not too soon to judge whether his policies will help the middle class. I make the same amount of money whether the rent comes from an honest, hard-working lower-middle class tenant or a lazy deadbeat getting government handouts.

You're kidding - right? It's certainly not too soon to judge whether his policies will help the middle class. I have no lust for the very wealthy, however, I do have a genuine dislike for having my money subsidize the lazy. I believe that people have the right to be lazy, but they should suffer the consequences of their choices - WITHOUT ANY SUBSIDY FROM ME!

Just about ever racial bigot I ever knew claimed he wasn't. They all seem to have some sort of contrived excuse that supposedly justifies their hatred and nastiness.

PM likes to think he is being rational and conservative, when in fact, whether or not he can see it, he truly hates anyone that isn't rich, simply because hey aren't rich and so far as being a conservative or being rational, he has no sense of what either might be. I suspect he is like the guy with sexual preferences he feels he has to hide and so is the first to volunteer for a night scouting for queers in the local bars to beat the sh-t out of. Poor Pm wants so bad not to be a common folk.


PM, being a tight assed stingy jerk will not let you into the upper class or the welthy.
