Forgent Announces USPTO to Reexamine the '672 Patent
AUSTIN, TX -- (MARKET WIRE) -- 02/02/06 -- Forgent(TM) Networks (NASDAQ: FORG) along with its wholly owned subsidiary, Compression Labs, Inc. ("CLI"), today announced it has received an ex parte reexamination order from the United States Patent and Trademark Office ("USPTO") regarding Forgent's data compression technology embodied in U.S. Patent No. 4,698,672 (the '672 Patent).
"We began investigating the '672 Patent in 2001 and have spent more than three years enforcing our property rights. We have not found any convincing arguments of invalidity, including the recent claims, and as a result we are confident in the patent, and look forward to an efficient re-examination," said Richard Snyder, chairman and CEO of Forgent. Forgent has pending litigation against approximately 30 companies for infringement of the '672 Patent in the United States District Court for the Northern District of California.

The '672 Patent relates to digital image compression used in digital still image devices that compress, store, manipulate, print or transmit digital still images such as digital cameras, personal digital assistants, cellular telephones, printers, scanners and certain software applications. I saw it start to go up last Thursday in what I can think is a win in their lawsuit against Microsoft. The news got delayed and it tanked to 2.7. I can only assume that the rumor mill about the case being released (indicating a FORG win against MS) to the public drove it back to 3.20's last week. Well, it got released and we all found out the patent is being reviewed... Tanked big time!!!
But I think this is good news. This means that the only way for FORG to lose the lawsuit is if the patent is no good. But I am inclined to think it is A/OK.

Japanese Company Enters Into License Agreement

("CLI"), today announced that it has concluded a Patent License Agreement ("Agreement") with Orion Electric Co., Ltd. covering Forgent's data compression technology embodied in U.S. Patent No. 4,698,672 (the '672 Patent). Orion is involved in the planning, development, design, production, and sales of audiovisual and information technology products. Other terms of the Agreement were not disclosed.
Forgent has pending litigation against approximately 30 companies for infringement of the '672 Patent in the United States District Court for the Northern District of California. Following the filing of the litigation, eleven companies that were defendants have entered into license agreements.
