The 11th U.S. Circuit Court of Appeals in Atlanta ruled Friday that the administration and Congress overstepped their authority by requiring nearly all Americans to buy health insurance or face a financial penalty -- the so-called "individual mandate" that is the key to financing the health care plan.
In June, however, an appeals court based in Cincinnati upheld the individual mandate -- a point the White House quickly made after Friday's reversal in Atlanta.
don't get too excited tho, the Constitutional solution is quite simple...
all you have to do to fix the unConstitutionality of it is to give a tax BREAK to those who "comply" and no break to those who don't
that way you are not punishing people for not complying only rewarding those who do...
the TParty loves Tax breaks right?

What a way to weasel the health care law and force it onto the people.
Whats really scary is now that they can force you from the day you were born to the day you die, what ELSE will they mandate on you? This is big government in the works and all you talkers against "big gubment" gave this bill a pass and keep blaming the Tea Party.
I mean seriously, do people blame the Tea Party when their septic systems back up, or when there have been pest nibblings in their backyard gardens?

cash, we are the only "First World" country without govt provided health care. Health care costs are bankrupting US more than income taxes are...
Obama actaully capitulated by allowing them to do this system rather than single payer.
requiring people to get health insurance is a favor to the private health care providers that they wanted, asked for and got.
One of the things that Obama ran on and was elected to do was to "fix" the health care system. His fix is not a good fix, but it is change.
the President only signs laws, Congress is supposed to write them, but they let the Lobbyists do that for them these days...

This country needs health care I hate to say it but the private sector can not provide for everybody therefore it has to be the gov.that will help out.

Id love to see every person receive health care...every legal person that is. You need lawyers to read the health care law, thats the problem. 2000 pages? I wonder just how many new government "oversight" committees were created from that bill anyway. They should have changed health care piece by piece. This way they dont screw up the entire system at once. You make a change one step at a time. I personally would start with the no denied coverage. Wait 6 months then review how it impacted the market. Then, move on to another change and wait 6 months. This way, in just a few years you are able to ease in new reforms and changes as opposed to them hitting you all at once.
One thing I would not have done is raised taxes on medical equipment manufacturers. There would be a government option, but no individual mandate. I also would not tax high cost health care plans. Lobbyists would not have influence on a true health care bill that was best for the people. Obamacare has special interest groups written all over it.
