Landmark Legal Foundation readies constitutional suit if Obamacare passes with Slaughter Solution By: Mark Tapscott Editorial Page Editor 03/17/10 5:58 PM EDT
Landmark Legal Foundation president and Talk Radio powerhouse Mark Levin promised today that his foundation will file suit in federal court challenging the constitutionality of Obamacare if it is approved in the House using the Slaughter Solution.
“Landmark has already prepared a lawsuit that will be filed in federal court the moment the House acts. Such a brazen violation of the core functions of Congress simply cannot be ignored. Article I, Section 7 of the Constitution is clear respecting the manner in which a bill becomes law. Members are required to vote on this bill, not claim they did when they didn’t. The Speaker of the House and her lieutenants are temporary custodians of congressional authority. They are not empowered to do permanent violence to our Constitution," Levin said.
23. Because the House violated the Constitution by never voting on the Senate Bill, the Senate Bill cannot be and is not a law of the United States. Defendants, charged by law and the Constitution with enforcing the law, must be prevented from treating the Senate Bill as a law of the United States. Any signature by the President is a nullity, and the piece of paper he has stated that he will sign or has signed is nothing more than that: a piece of paper.

I would say law suits that will go nowhere. This reaction is mild as to what I thought it would be.
The insurance co's are really mad about the fact that if they stay in and and play they will be capped at 15% to 20% on gross reciepts to operate with instead of the 31% they make now. If that one part was not in the plan you would have seen this over with by now with big smiles on the the Ins co's faces and there lapp dog politicians faces.

if they actually file the lawsuit(s)? the Judiciary will answer the question won't they? or will they? the losing side can just claim judicial activism or judicial incompetence...
it would be bad for the bill to be deemed to be passed without a vote. for everybody.
pass it or vote it down- take a position. it's time to put up or shut up.
it sure looks the vote will be soon, and we'll find out this fall how popular or unpopular it is...
as of right now? i don't think that many people will be voted ou tof office for it.
there's a few Dems that won GOP districts that will lose them back, but they would lose them back anyway unless the jobs numbers were to miraculously change, and they won't....
they won them because people were fed up, and they still are...
