i am tired of hearing people say they want to return to the US Constitution in one moment and ask for "tort reform" in the next breath.
US Constitution Amendment 7 - Trial by Jury in Civil Cases. Ratified 12/15/1791.
In Suits at common law, where the value in controversy shall exceed twenty dollars, the right of trial by jury shall be preserved, and no fact tried by a jury, shall be otherwise re-examined in any Court of the United States, than according to the rules of the common law.
that is a plain and clear statement. trial by jury in civil cases means that the jury decides what damages are.... not congress or the president
