I was very surprised by the statement that Obama made concerning the upcoming trial/tribuneral or whatever the hell it is going to be. It got worse with Gibbs comments concerning the conviction of KSM.
I am not an Obama "supporter", but I try to be a "respecter."
Any defense attorney is going to have a field day with those comments. They will say that coming from the president, those comments poisoned the entire jury pool from any location in the country...... and I think I would agree with them.
So.... does that mean that any subsequent conviction can be appealed on those grounds if it is tried by the justice system? Has Obama shot his own desire for trial in the foot and will now have to use a tribuneral? Even then you have military persons sitting in judgment after their Commander in Chief has made a questionable statement concerning the accused's guilt.
I feel confident that Obama and Gibbs both did not mean for the comments to come out the way they did, but that doesn't really matter. I still think that it was HUGE gift to KSM lawyers.
I'm spitballing here and I am sure it would never happen, but I think given the circumstances it should be tried at the Supreme Court (I understand that they usually rule on Constitutionality rather than determining guilt in murder cases) but it is probably going to end up with them now anyway; after years in the legal system.
Plus after the executive branch's goof..... it puts an equally powerful branch in a position to ensure fairness right from the start.
Any thoughts?
