Clayton Kelly, a conservative blogger and self-professed supporter of state Sen. Chris McDaniel, is accused of sneaking into an assisted living home where Cochran's wife, Rose, lives, taking photos of her and posting them online.

On Sunday, he shook his head as a police officer testified how investigators discovered the case.

“That video was posted and ... put out there in the Internet where other people obtained copies of it and that's how we received the report,” the officer said.

Kelly's attorney claimed his client was cooperating with police, does not have an extensive criminal history and should have his bond lowered to $10,000 or $20,000.

Judge Dale Danks denied the request.

Prosecuting attorney Trae Sims argued that the bond fit the crime. “The city has an interest in protecting those folks and takes those cases seriously, and protecting the community and keeping the community safe is one of the elements you look at when setting a bond,” said Sims.

Kelly replied to the judge only with yes and no answers. He kept a straight face even as his wife cried in the courtroom.

Kelly faces felony charges. He is due back in court on Thursday.

Madison police are still investigating whether other people were involved in the break-in.

i get this invasion of privacy issue. i really do. the guy took pictures of a Senators wife, we must protect the privacy of Senators wives... right? never mind that theye can download every picture in your cell phone whenever they want for any reason...

The Vulnerable Persons Unit was created by the Attorney General in 2001 in response to the revisions made by the Legislature of the Mississippi Vulnerable Adults Act.

The Vulnerable Persons Unit investigates and prosecutes persons who abuse, neglect, or exploit a vulnerable adult residing in a private home. Mississippi law defines a vulnerable adult as a person, whether a minor or adult whose ability to perform the normal activities of daily living is impaired due to a mental, emotional, physical or developmental disability or dysfunction, or brain damage or the infirmities of aging.

The law also established criminal penalties for committing these offenses ranging from one year in the county jail to 40 years in prison.

This unit currently consists of one prosecutor and five investigators who coordinate with local law enforcement as well as with the Department of Human Services to guarantee that Mississippi’s vulnerable persons in private homes are protected.

This unit is also responsible for conducting state-wide training of law enforcement officers , judges, district attorneys, state agencies and investigators at the Department of HS with regard to issues arising under the Vulnerable Persons Act. This training provides insight to street level police officers in the specific areas of recognition of, and proper response to, allegations of exploitation of individuals who meet the criteria under vulnerable adult laws.

Complaints of abuse or neglect of patients living in health care facilities, such as nursing homes or personal care homes, should be reported to the Medicaid Fraud Unit of the Attorney General’s Office at (601) 359-4220 or toll free 800-852-8341.

Who is a Vulnerable Person?

Any person (children included) whose ability to perform the normal activities of daily living or to provide for his/her own are or protection is impaired due to a mental, emotional, physical or development disability or dysfunction, or brain damage or the infirmities of aging. This includes all residents or patients of a care facility.

What is abuse?

The willful or non-accidental infliction of physical pain, injury or mental anguish
The unreasonable confinement of a vulnerable person
The willful deprivation by a caretaker of services which are necessary to maintain the mental and physical health of a vulnerable person.
Includes sexual abuse
Does not mean conduct which is a part of the treatment and care of, and in furtherance of the health and safety of a patient or resident of a care facility
Includes, but is not limited to, a single incident

What is neglect?

The inability of a vulnerable person who is living alone to provide for themselves the food, clothing, shelter, health care or other services which are necessary to maintain their mental and physical health

The failure of a caretaker to supply the vulnerable person with the food, clothing, shelter, health care, supervision or other services which a reasonably prudent person would do to maintain the vulnerable adult’s mental and physical health

Includes a single incident

What is exploitation?

The illegal or improper use of a vulnerable person or his or her resources for another’s profit or advantage with or without consent of the vulnerable person, and includes acts committed pursuant to a power of attorney

Authorities say the vice chairman of the Mississippi Tea Party and two other men conspired with Clayton Kelly to photograph U.S. Sen. Thad Cochran's bedridden wife in her nursing home and create a political video against Cochran.

Mark Mayfield of Ridgeland, an attorney and state and local tea party leader, was arrested Thursday along with Richard Sager, a Laurel elementary school P.E. teacher and high school soccer coach. Police said they also charged John Beachman Mary of Hattiesburg, but he was not taken into custody because of "extensive medical conditions." All face felony conspiracy charges. Sager also was charged with felony tampering with evidence, and Mary faces two conspiracy counts.

The arrest of Mayfield, well-known in political, business and legal circles, caused shock in Mississippi, in a criminal case and election that already had Mississippi in the national spotlight.

Mayfield's attorneys — Merrida Coxwell and Mayfield's brother-in-law, former state Rep. John Reeves — quickly posted cash for Mayfield's release on a $250,000 bond but called it excessive. They and Kelly's attorney said the case appears to be politically driven.

"There's a lot of bigger powers moving, and that's why this case wasn't handled the way it should be," said Kelly's attorney Kevin Camp, who argued Kelly should face, at worst, a misdemeanor. Instead, felony charges of conspiracy and photo voyeurism were added to the count of exploitation of a vulnerable adult he already faced. He faces a total of 20 years in prison.

"It's all about politics," Camp said.

Cochran's opponent in a bitter GOP primary race, tea party-backed state Sen. Chris McDaniel of Ellisville, continued to deny any involvement with Kelly or the video and to accuse Cochran of gaming the incident for political points.

Authorities said they have no evidence at this point linking the alleged conspiracy to a campaign. But Cochran's camp has continued to question when and how McDaniel and his staff knew of it, and point to inconsistent answers McDaniel and others on the campaign have given since Kelly's arrest Friday night.

McDaniel in a statement Tuesday called on Cochran to take down a new ad. It says a "Chris McDaniel supporter has been charged with a felony for photographing his wife in a nursing home. Had enough? … Rise up against dirty politics."

McDaniel said, "It is shameful for a sitting U.S. senator to engage in such desperate slander and lies."

Mayfield has been an ardent supporter of McDaniel, as have the Mississippi Tea Party and the Central Mississippi Tea Party, both of which list Mayfield on their boards of directors. Tea party officials did not respond to requests for comment Thursday.

A photo posted recently on the McDaniel campaign's Facebook page shows Mayfield and other volunteers, saying, "Here's part of a crew that reached over 500 homes walking in Madison today. Great work team!"

Kelly, 28, of Pearl is a McDaniel supporter and an aspiring political blogger with the site "Constitutional Clayton." His friends and family say he wanted to make a name for himself and the blog, and was egged on by others over the Internet to do a hit piece on Cochran. He was trying to claim Cochran has a mistress — which Cochran has denied — while his wife languishes in a nursing home.

Kelly's wife said someone on the Internet gave him info on how to find Rose Cochran at St. Catherine's Village, and he photographed her on Easter Sunday.


so the primary is June 3rd, i wonder what they'll do next... T-Party versus old-boy conservative? we can't win or lose....

these guys are posting six-figure bails or stayng in jail? i dunno... these guys are scum if they did this, no doubt. but i'm not convinced that anybody but politician could actually get bail to be more than 5,000 bucks for simple picture taking. there are pictures that could warrant six-figures, but the charges are that they took the picture form outside the room and nothing else. from what i can gathrer one of the "cosnprators" also
has a sick Mother in the same home and that's how the picture taker got itnot he building, so it's not even illegal entry.. but who knows maybe there's more news to come...

so I've been really derelict in not updating this story.

The T_Party guy and Thad the Old-Party Guy "tied" in the primary...

actually not... the last i checked? the T-party guy won by over 1000 votes but both guys only had 49%. Som other cnadidates had enpugh votes to keep either guy from getting 50%. So there's a run-off.

Now The the Old-Party is reaalllly reaaallly friggin old. Senator (R-MS) since 1978
Previous office: Representative (MS 4th District) 1973–1978. He's got a stranglehold on MS politics. Heck he's got outhouses named after him down here.

Seems like this will be what they get him on. I can't imagine it be a 40 year sentence.

i'm sad to say that i know why we need laws like this, seen it first hand.Power of Attorney abuse is just wrong.

on the other hand? if it weren't Thad Cochrans wife? I doubt this would ever be considered worthy of police attention, much less porsecutors....

You're absolutely correct in that. Politically motivated to be sure. But the accused is the dumbf who entered and took the video.. Then added to his idiocy by posting it.

You know me I'm all about no gubment and limited laws, but this guy did bring it on himself.

And why?

So his buddy who will be just as bad as Cochran can win?

Who cares?

They're all the same... Even the idiot tea party saviors.

aapparently i can drive just up the road apeice and try one of the "best steaks in the US"... i've driven by this place and a hundred others just like it down here, i didn't go in this one, but i have made the mistake of going itno a few ( very few) mostly cuz this is the normal "architectureal style" here in the MS Delta...

this isn't a joke. i mean it is a joke but it's not a funny one.... in most of these places and most gas stations, you get deep fried "somthing" and the grease isn;t considered broken in until it's been used at least 30 days....
most places recycle used cooking grease for deisle fuel these days? here they recycle it for cooking [Big Grin]

The tea party was real for just shy of six months. I saw a real movement starting with real folk engaging. Granted none of them were smart enough to realize 9/11 was a false flag.. None of them learned enough to realize the 1993 WTC bombing facts.. nor capable enough to spend even four seconds reading about operation northwood..

But hey, they were trying, even if sub 120 I.Q. dumbf's

Ok, so Cochran beat the T-party guy in the run-off.

big problem brewing in this though. Apparently a huge turnout in the counties surrounding where i live gave Cochran the win, but if those voters voted in the democratic primary? They are not legally eligible to vote int he GOP run-off. I was wondering how that worked before the elections and NOBODY said a word about it on the local news. Now, they are beginning to talk about it. They wil lmost likely have to reject tens of thousand of votes. The counties that have triggered this are alos the ones in question about voters rights due to teh fact these counties are huge majority African american and Democrat. Cochran won htese Democart-African American Counties by a very large margin... It was considered an oddity at first, but now the news is that f they voted in the original primary on the Democat ballot? They can't vote again int he GOP run-off, and you can't request differnt ballots to vote on differnt races like vote GOP in the Senate race and Democart in Mayors races... This story will most likely go on for months... I also expect to hear voters claiming they are being disenfranchised because they were not informed that they cannot vote in the run-off. This could become very intersting (in a bad way)

Sen. Thad Cochran's narrow victory over Chris McDaniel in the Mississippi Senate runoff deprives Democrats of their argument that Republicans are beholden to the tea-party wing of their party. But it offers them some optimism that African-American voters will show up in healthy numbers for the midterm elections, given that they made the difference in a Republican runoff in a deeply conservative state.

There was clear evidence that Cochran's attempt to boost Democratic African-American turnout paid off in a big way. In Jackson's Hinds County, where two-thirds of the population is black, Cochran won 73 percent of the vote, 7 points higher than his performance in the primary. Turnout was up significantly in heavily African-American counties in the Mississippi Delta, like Quitman, Sharkey, Humphrey, and Coahoma, where Cochran increased his primary-election margins over McDaniel. Over 347,000 voters cast ballots in the runoff, a higher total than in the primary—marking the first time in 30 years that has happened in any Senate race.

"Looking at county data, Cochran's #MSSEN win is almost entirely attributable to a large turnout increase among black voters b/t 6/3 and 6/24," tweeted Cook Political Report analyst David Wasserman.

During the runoff, Cochran made overt appeals to the state's sizable African-American electorate, including several television ads featuring the senator campaigning with black voters. The New York Times reported that the leading pro-Cochran super PAC, Mississippi Conservatives, paid African-American leaders to get out the vote for the senator in the runoff.

I used to go to MS all the time to visit family. Small town called Mt Pleasant just SE of Collierville. Lots of local stew cookings, creamed corn, fried catfish, all sorts of good food.
