over the last six months gzfx, cnes, msep have been heart breakers....but if you were bottom feeding then even 100 bucks would be raking in some good profit today...

Also, I do agree that CAPT has made some good picks, I just objected to the manner that he presented them. I am a litigation attorney, and I have some (although not alot) of Securities litigation experience, and you really can face liability for passing on insider information, it is called "tippee liability" Nonetheless, I really think CAPT was "puffing" at best or lying at worst about his conversations with the CEO. I have my own reasons for feeling this way, but suffice it to say that CAPT is not the only person who has a telephone.

cash, I unnstan somebody like Bill Gates or...gulp... even Martha Stewart having isider info, but if I call the company & they tell me some stuff and I tell my friends or publish in the local paper--how am I an insider trader? isn't this still the USA? free-flow information, etc...

Well, like I said before it is not always black and white, but a short synopsis is as follows:
The term "insider information" only applies to certain classes of information. General news about the direction of a company or any other public information may be freely exchanged. An insider of a company should never reveal non-public infrmation that is material to business operations, and if they do they can face liability for the release of the information without any "trading" of the stock. For a non-insider the "mens rea" is a much higher burden, but, if you find out information that you know you shouldn't know (and assuming it is not yet public) you may not trade on the information, nor tell anyone else to, otherwise you could be held liable yourself.
Most executives still talk to investors, but they tell them information that is already in the public purview--even if the person hearing it has never heard it.
Also, if you get a "tip" from a non-insider (for example the janitor at a company, who found out by overhearing the CEO) you will not face liability, in this situation you did not obtain the information from an insider, and even the janitor would not face liability because he did not exploit a fiduciary, he merely was in the right place at the right time.
