Sanford Police Recommended Charging Zimmerman With Martin’s Death, But Police Chief Claimed ‘No Probable Cause’

Then-Sanford Police Chief Bill Lee with investigator Chris Serino The Miami Herald reports that the Sanford Police Department, at the conclusion of its Trayvon Martin investigation, recommended that the prosecutor file charges against the shooter George Zimmerman. Angela Corey, the special prosecutor now assigned to the case, confirmed the report:
“As far as the process I can tell you that the police went to the state attorney with a capias request, meaning: ‘We’re through with our investigation and here it is for you.’ The state attorney impaneled a grand jury, but before anything else could be done, the governor stepped in and asked us to pick it up in mid-stream.”
A capias is a request for charges to be filed.
State Attorney Norman R. Wolfinger, who was initially assigned the Trayvon Martin case, failed to act on the recommendation for charges against Zimmerman.
This new information directly contradicts the public statements that Sanford Police Chief Bill Lee (who has now “temporarily” stepped down) made on March 12, the day he turned the case over to the state attorney. He claimed that, at the time, there was not enough evidence to charge Zimmerman with a crime and arrest him:
Police Chief Bill Lee said there was not enough evidence to arrest George Zimmerman, who followed Martin in his SUV and ended up confronting the teen before shots were fired.
“In this case Mr. Zimmerman has made the statement of self-defense,” Lee said. “Until we can establish probable cause to dispute that, we don’t have the grounds to arrest him.”
These statements now do not appear to reflect the actual views of the Sanford Police, as communicated to the prosecutor. It only adds to the serious questions about the conduct of Lee and other members of the Sanford police in this case. While Lee was in charge of the Sanford Police, they did not test Zimmerman for drugs or alcohol, “corrected” a key witness, and amended the police report to bolster Zimmerman’s claim of self-defense.

Why is there no outcry like this when black kids are killed every day in black on black crime (gang violence?) Where is Al sharpton and the movement to stop the violence from within which is the most damaging? The black panthers put a bounty out for zimmerman and these people are acting like the klan ran through their town in hoods and torches and hung someone.

cash, i might have mentioned to yo that i live in an area where the majority is black, about 70%, it's not just my coutny it's the whole MS delta Region which is about 200 miles by 200 miles...... there is outcry, but the media doesn't pay much attention.

as i understand "self-defense" ? it is an "affirmative" defense- that means that there is an extra burden of proof on the State to overcome that. That *could* be why the States attorney acted more slowly....
apparently there is a question about witness "tampering" or "intimidation" to validate teh self-defense claim....
in other words some patience is called for.

Filmmaker Spike Lee apologized to David and Elaine McClain of Sanford, Florida on Wednesday night after re-tweeting their address out to his 250,000 followers last week. Mr. Lee thought the McClain's address belonged to George Zimmerman, the 28 year old man who fatally shot 17 year old Trayvon Martin last month (background here). In a tweet Mr. Lee wrote:
"I Deeply Apologize To The McClain Family For Retweeting Their Address.It Was A Mistake.Please Leave The McClain's In Peace.Justice In Court."
The McClains were forced to flee their home and stay at a local Sanford hotel after their address was tweeted out to hundreds of thousands of twitter followers

Trayvon Martin: The 5 Key Unanswered Questions

Trayvon Martin, as he appeared on his actual Facebook page It’s been more than a month since Trayvon Martin was shot dead by George Zimmerman. (Get a full rundown of the facts of the case here.)
Tonight, ABC News release video footage of Zimmerman arriving at the police station. The video depicts a cleanly-shaven man who “shows no blood or bruises” on his body.
While media coverage of the case has been intense, there are several key questions that have yet to be answered about the case. Here are five of the most important:
1. What was the purported “conflict” that required the initial prosecutor to step down? On March 22 — after several weeks on the job — state attorney Norm Wolfinger stepped down from his role as prosecutor in the Trayvon Martin case. Wolfinger relinquished his post after meeting with Florida Gov. Rick Scott and Attorney General Pam Bondi. He said it was necessary for him to step aside to preserve “the integrity of this investigation,” adding he wanted to avoid “the appearance of a conflict of interest.” He did not explain why his continued involvement would damage the integrity of the case or explain the potential conflict he was seeking to avoid. Did anyone at the prosecutor’s office know Zimmerman or his family? [Orlando Sentinel]
2. Why did the prosecutor ignore the recommendations of the lead homicide investigator? ABC News reported that Chris Serino, the lead homicide investigator on the Trayvon Martin case, recommended that Zimmerman be charged with manslaughter on the night of the shooting. Serino filed an affidavit that night stating “he was unconvinced Zimmerman’s version of events.” As the lead homicide investigator, Serino was: 1. In the best position to evaluate Zimmerman’s credibility, and 2. Intimately familiar with Florida law. Why was he ignored? [ABC News]
3. Why did then-Police Chief Bill Lee make public statements directly contradicting the official recommendations of the police department? On the day the Sanford Police concluded their investigation and handed over the case to the prosecutor, then-Police Chief Bill Lee stated publicly that there was no “probable cause” to arrest or charge Zimmerman. (Lee has subsequently “temporarily” stepped down from his post.) But the Miami Herald reports that on the same day the Sanford Police formally requested that the prosecutor charge Zimmerman, something known as a “capias” request. [ThinkProgress]
4. Who leaked Trayvon Martin’s school records? As public outrage increased, Zimmerman’s sympathizers launched a smear campaign against Trayvon Martin. This included details of several occasions where Martin was suspended for minor infractions (defacing a locker, possessing an empty “marijuana baggie.”) None of the information seemed to have any particular relevance to the night Trayvon Martin was shot to death. Was this a ham-handed attempt by the police or the prosecutor to defend their lack of action against Zimmerman? The Sanford City Manager announced he would launch an independent investigation into the source of the leak. [Miami Herald; NBC12]
5. Why was Trayvon Martin’s body tagged as a John Doe? The Washington Post’s Jonathan Capehart notes a police report “that was completed at 3:07 a.m. on Feb. 27 lists Trayvon’s full name, city of birth, address and phone number.” But yet, Trayvon’s body was reportedly “tagged as a John Doe” and his father wasn’t informed of his death until after he filed a missing person report later on the 27th. Why weren’t Trayvon Martin’s parents contacted immediately after the police confirmed his identity? [Washington Post]
Special prosecutor Angela Corey has promised to release additional information about the case once she makes a decision about whether to charge Zimmerman, something that could happen at any time.

Now, I dont put a lot of worth into astrology and the signs, but I do believe there is something in this universe way beyond our comprehension that could be having a toll on Earth.

i was given an astrologocial reading by a 'pro" as gift one time about 30 yrs ago now...
i was sure she had done BI on me..... i dunno if she did or not, but her predictions truned out be pretty true too. not specific but also uniquely apropriate.
IMO? it's got nothing to do with the leaves in the bottom of the cup and everything to do with the reader
you have to admit this Trayvon case is plain strange and i for one am glad we all looking at it hard. That may not have been able to happen five years ago.

If George Zimmerman is not arrested soon in the shooting death of Trayvon Martin, the Rev. Al Sharpton will call for an escalation in peaceful civil disobedience and economic sanctions, Sharpton said Friday.
The militant New Black Panther Party issued a $10,000 bounty on the head of George Zimmerman. They have called for his capture “dead or alive.” A “Kill Zimmerman” Twitter account has been created that is filled with hate and calls for violence.
On CNN last night, George Zimmerman’s brother said that the family has received death threats.

NBC told this blog today that it would investigate its handling of a piece on the “Today” show that ham-handedly abridged the conversation between George Zimmerman and a dispatcher in the moments before the death of Trayvon Martin. A statement from NBC:
“We have launched an internal investigation into the editorial process surrounding this particular story.” Great news right there. As exposed by Fox News and media watchdog site NewsBusters, the “Today” segment took this approach to a key part of the dispatcher call:
Zimmerman: This guy looks like he’s up to no good. He looks black. Here’s how the actual conversation went down:
Zimmerman: This guy looks like he’s up to no good. Or he’s on drugs or something. It’s raining and he’s just walking around, looking about. Dispatcher: OK, and this guy — is he black, white or Hispanic? Zimmerman: He looks black. The difference between what “Today” put on its air and the actual tape? Complete: In the “Today” version, Zimmerman volunteered that this person “looks black,” a sequence of events that would more readily paint Zimmerman as a racial profiler. In reality’s version, Zimmerman simply answered a question about the race of the person whom he was reporting to the police. Nothing prejudicial at all in responding to such an inquiry.
In an appearance on Fox News’s “Hannity,” Brent Bozell, president of the conservative Media Research Center, called this elision on the part of ”Today” an “all-out falsehood” — not just a distortion or misrepresentation.
And it’s a falsehood with repercussions. Much of the public discussion over the past week has settled on how conflicting facts and interpretations call into question whether Zimmerman acted justifiably or criminally. That’s a process that’ll continue. But one set of facts in the is ironclad, and that’s the back-and-forth between Zimmerman and the dispatcher. To portray that exchange in a way that wrongs Zimmerman is high editorial malpractice well worthy of the investigation that NBC is now mounting.

Mass Shooting by Black Gunman in Miami – Obama, Sharpton, Spike Lee & Farrakhan Nowhere to be Found
NORTH MIAMI (CBSMiami) – Fourteen blacks have been shot and two are dead in what may be one of the worst mass shootings in South Florida history and no one can seem to find Obama, Sharpton or Spike Lee to organize a rally, march on police stations, place bounties on the heads of the shooters or stage phony press conferences. This time it is fourteen innocent blacks shot, one a 5 year old girl! Two have died. Where’s the outrage? The shooting took place around 9:30 p.m. outside the Funeraria Latina Emanuel funeral home at 14990 W. Dixie Highway Friday night. One of the victims, a 43-year-old black man, died outside the funeral home, authorities said. The other, a 27-year-old black man, died at the hospital. Witnesses at the funeral home had said one of the two people killed was shot in the chest. Their names have not been released.
A 5-year-old girl, identified by her family as Mckayla Bazile, was shot in the leg and hospitalized at Jackson Memorial Hospital along with eleven other victims. The shooters were young black males.

without being able to find any real data on the scene? my *GUESS* is that it was gang related. Thats what funeral drive-bys ususallly are...
it's also the same thing they've been doing in the mideast to "quell" the rebels- the "cops" and th emilitary go to funerals and shoot the relatives of the people killed in the riots the day before.

Aventura Police Sgt. Chris Goranitis told CBS4 News the funeral was for 21-year-old Morvin Andre who died on March 16th, one day after he jumped from the 4th to 2nd floor of the Aventura Mall parking garage in an effort to escape pursuit by Bloomingdale’s loss prevention employees.
The Medical Examiner ruled his death a suicide because he chose to jump rather than be apprehended, according to Goranitis.
Meantime, a senior police commander told CBS4 investigative reporter Jim DeFede that Andre had some connection to several South Florida gangs and some of those gang members were in attendance at his wake to pay their respects.
The commander said someone at the wake touched Andre’s body in the casket in a way that other gangs took as disrespectful. This led to an argument inside the funeral home which spilled out to the street.
that's not what i was guessing, i was guessing it was another gang, not his gang...intersting suicide decalration, it protects teh securtiy staff from any legal ramifications, which is A-OK by me...(as long as he really jumped of his own accord)

NBC issues apology on Zimmerman tape screw-up

NBC has completed its investigation into the mishandling of the police dispatcher’s conversation with George Zimmerman in the Trayvon Martin case. And the process ends with a finding of error, plus an apology. Here is the statement just issued by the network:
During our investigation it became evident that there was an error made in the production process that we deeply regret. We will be taking the necessary steps to prevent this from happening in the future and apologize to our viewers. That apology addresses the “Today” show’s failure to abridge accurately the conversation between Zimmerman and the dispatcher in this high-profile case. This is how the program portrayed a segment of that conversation:
Zimmerman: This guy looks like he’s up to no good. He looks black. And here is how it actually went down:
Zimmerman: This guy looks like he’s up to no good. Or he’s on drugs or something. It’s raining and he’s just walking around, looking about. Dispatcher: OK, and this guy — is he black, white or Hispanic? Zimmerman: He looks black.

NBC's apology makes interesting use of the word "error;" an "error in production" they say. That wasn't an editorial "error," but an editorial choice. It wasn't mistakes that were made, but choices and that's why it's a very serious matter.
A person or persons made editorial choices that changed the content of the story. NBC certainly owes a public apology to George Zimmerman and if they'd care to have their viewers' trust in future, they owe them more, too.

Man, 78, recounts assault by 6 youths in E. Toledo
Six juveniles -- the youngest 11, and the oldest 17 -- nearly boxed in Dallas Watts, a 78-year-old man from East Toledo.
Mr. Watts was on his way home from the nearby Gas Express Mart at Starr Avenue and White Street about 4:45 p.m. Saturday when the boys approached him.
"While Mr. Watts was down the boys kicked him, over and over, shouting, "[Get] that white [man]. This is for Trayvon ... Trayvon lives, white [man]. Kill that white [man]," according to a police report."

WAS it murder ray ray? What if it was Zimmerman crying out for help and was being beaten to what he reasonably thought was death? If trevon did attack him and pound his head into the ground, this type of action is just.
What I do not agree with is before that he was told by the police dispatch to stay put. So that right there begins a total change of things. I think he should be charged with manslaughter to come to a middle ground.
As for NBC editing a phone call with the police to make a story out of it, those people should be fired. If you were an honest man, you would want the crew who put on that stunt fire too.
I will tell you what it NOT was, some grand cyclops from the KKK riding into Birmingham and stringing someone up. This whole huge racial argument needs to get back to reality.

that's why this infuraites me on so many levels.
first and foremost? i am a gun owner, and if martin gets off? i WILL lose rights. period end of story, we are back to square one on keeping the 2nd open to us.

gun owners out there, YOU must demand that other gun owners just plain be responisble without a hundred laws to follow, so that YOU will not lose your rights, do not defend irresponisble people or you are shooting yourelf in the foot!
rights adn responsibilites go hand in hand. just like voting, you have a responsibuiltiy to prove you are who you appear to be to claim the right to vote. get it?

yes I do get it glass, Zimmerman is as good as dead. As for this gun law this was not what it intended for.

We are (supposedly) a nation of LAW, Ray. If Zimmerman broke the law, as I believe he did, then we need to let the LAW punish him. This garbage of Spike Lee tweeting what he thought was Zimmerman's address and quite plainly encouraging violence against him (And in the process ruining two lives who had nothing to do with Zimmerman) must stop or the street will run red, Ray....
As for your post, Glass, I carry (part of living in a 'free' State). I do expect other gun owners to act responsibly and feel that consequences should follow those that break the law. However, Stand your ground (again, whether it applies here should be determined by the legal process, not the media) and the Castle Doctrine MUST exist and be respected if we are to remain a free people. Period.

i stand my ground, and i relaise that at just past 50, i will not be able to much longer without a hogleg.. that said, i agree with ray that stand your ground is not what happened here.
i have a really nice North Americna Arms .22 LR and Mag that has belt buckle mounting device. It is a real belt buckle and is pretty cool and it works, alot of people don't realis that .22 magnum is between 9mm at about 500footpounds and a .380 (-POS round IMO) at 200 ft/lbs. .22 WMR? 320 footpounds... serious power if applied in the right place... held in the palm of the hand? this 5 rounder is invisible...
still? i don't carry it around when i got town cuz i belevie it might make me overconfident and lead me to a place where i then migt need and use it when i normally wouldn't... i would not hesitate to carry it if i was dealing in large sums of cash, but i haven't been that fortunate yet..

This is not what needs to be happening as this could very easily spill over from the Trevon case to the neo nazis and the black panthers having shootouts in the streets. Liberal news network NBC trying to save face in mounting pressure on Zimmerman call. This coming from the network that has AL SHARPTON as a face on MSNBC.
Al Sharpton, Ed Schultz, Lawrence Odonnel, Rachel Maddow, and formerly KEITH OLBERMAN. Can a line up get any more one sided and biased than this? Not even Fox News night time is this far to one direction.
Trayvon Martin call was "mistake, not deliberate": NBC
Reuters) - NBC News' decision to air an edited call from George Zimmerman to police in the moments before he shot Trayvon Martin was "a mistake and not a deliberate act to misrepresent the phone call," according the president of network's news division.
The edit in question, which aired on the network's flagship "Today" morning show last week, made it appear that Zimmerman told police that Martin was black without being prompted, when, in fact, the full tape reveals that the neighborhood watch captain only did so when responding to a question posed by a dispatcher.
Under growing public pressure to explain the incident, NBC News President Steve Capus provided Reuters with the fullest explanation to date of how the edited call made it on air and what the network is doing to prevent such a consequential error from happening again.
Capus confirmed a previous Reuters report that an internal network investigation had determined that a producer made the editing error, and that the network's editorial controls - including senior broadcast producer oversight, script editors and often legal and standards department reviews of sensitive material to be broadcast - simply missed the selective editing of the phone call.
He said the producer has been fired and "several people" involved were disciplined, though he declined to specify the nature of the disciplinary actions, saying they were internal personnel matters.
Sources at the network told Reuters on Thursday that NBC News executives did not know the emergency call was misleadingly edited until news reports surfaced days later on blogs including newsbusters.org and Breitbart.com.
Those blogs, along with media critics and rival networks, have charged that the edited call has inflamed racial tensions in an already volatile situation.
Sources inside the network have told Reuters that NBC News brass interviewed more than a dozen staffers during its investigation of the matter.
As part of the investigation, the producer who edited the call was questioned extensively about motivation, and it was determined that the person had cut the video clip down to meet a maximum time requirement for the length of the segment - a common pressure in morning television - and inadvertently edited the call in a way that proved misleading.
NBC News has apologized for the incident, saying in a statement to Reuters earlier this week that there was "an editing error in the production process," but insisting the results of the internal investigation would not be announced publicly.
Capus said that the network "takes its responsibility seriously" and has undertaken rigorous efforts to formalize the editorial safeguards in place at the network.
He said that NBC News' broadcast standards department, led by David McCormick, has been holding meetings with various NBC News shows, as well as the network's specialized units, which handle sometimes complicated subjects like medical or legal news. Capus added that he also is holding meetings among the network executives to reinforce the lessons learned from the investigation into the edited call.
